There is a collection agency out of Oklahoma City, they had 4 entries on my husband's Experian, and 3 on Equifax. I sent them a validation letter and they ignored it, they did not not on my reports that it was under dispute either. I listed the accounts on the validation letter, it has been about 45 days since I got the green card back. I got an email from Credit Expert that there was important changes. I logged in to see what the deal was, and this collection agency inserted two items from 1999 that were before only on Equifax onto Experian. One account was for $12 and the other for $6, not a huge drop in points, 13, but when your score was 550 to begin with that hurts a lot. Okay, number one, they did not respond to the validation, that is a violation, right? They did not note on my reports that it was under dispute, another violation? They then added two accounts to Experian, I am 100% sure this was for spite. What do I do? They are not trying to collect on these debts. Do I file suit, even though these may be my accounts? I filed complaints with the FTC and the BBB of Oklahoma City. Experian refuses to use the green card and them not validating this as additional information because the accounts have been verified twice. I am in Texas, would I sue them in my county or would I have to do it in Oklahoma City. Please advise, the other company out of Kansas I have posted about has nearly beaten me down, I cannot deal with more of this. Thanks!
1. If they verified with the CRA while they had a validation request, that is a violation. See this site for the FDCPA: http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm#809. 2. YES!! 3. You can file suit if they violated the law, whether it is your account or not. You didn't say it wasn't you asked for validation which they failed to provide. 4. If you live in Texas, file with the Texas Attorney General as well, you can do it online at www.oag.state.tx.us. 5. Experian SUX!! 6. You sue them in your local county. They have to travel.
Christi, They also have these listed as installment accounts? They did not verify while these were in dispute, Experian would not allow me the investigation since they had already been done twice. They changed their name slightly for the new entries Will the Texas AG do any good since they are in Oklahoma?
The Texas Attorney General regulates collection agencies in Texas, so since I live in Texas I always file a complaint with them as well. Collection Agencies MUST be bonded in Texas to collect in Texas. I don't have the number, but you can call the AG or do a search here for the posts with the number. If they are NOT bonded and in good standing the Texas AG will quickly back you up. Christi, They are not trying to collect, at least I haven't heard from them at all regarding the newest collections. I would assume that I would have to have a collection letter from them for that to work. Is there any other options for me?
