I am so mad!

    I disputed an account with Experian as being a duplicate account. There were two accounts showing with First National Bank of Marin because in December of 2001, I had my purse and my car stolen. They gave me a new account number and transferred my balance to the new account.

    I get my mail yesterday and there is my updated report from Experian and this is what is on it:

    First National Bank of Marin --- updated:

    Account charged off, $73 written off, charged off as of 12/2001.

    WHAT THE HELL! I am so angry....what do I do to correct this?

    It wasn't charged off as bad debt, it was a stolen card.


    Please help me!!

    Send a letter to Bank of Marin. State that you disputed the account with the CRA and they have INCORRECTLY updated the listing. Demand they delete the listing, update the listing as "paid never late & card stolen", or you will sue them.

    Same time send a procedural request letter to the CRA to get a record of who, what, and when, the verification information was received.

    When you get the letter from the CRA and a response from Marin, you will have a clear evidence trail to file a suit against one or both of them for violations of the FCRA.

    I agree with almost everything here. As far as a letter to the bank - yes. But, I think you need to start out nicely asking for corrections to be made. It is entirely possible that the cra never did verify it. So, it is possible it isn't the banks fault. Now, if a nice letter doesn't work, then by all means send an intent to sue letter. But I think you should give the bank the benefit of the doubt first.

    Oh alright ... if you wanna be nice at first I guess that is ok. LOL j/k

    I agree it is always best to try with civility to have the bank correct the mistake. But it is so much more fun when they refuse and you gotta get mean :))

    Are there any templates of a procedural request letter that I can send to the CRA? I am not too good of a letter writer...

    For ANYONE with challenges with FNBM, Email the customer service email (located on their website). State: For the President. Then detail your problem.

    They have an office especially set up for those who go for the highest level.

    When I did this.....

    I got a call from the office of the pres the next day. Understand, my account had ballooned to $945 because of those nasty late charges and over the limit charges. I pointed out that they are charging me for something I never got (the savings account). Then they are heaping fees and interest on top of that! I told them that I had attempted to close this account this past august and they failed to do it.

    That day I got a response that my account was closed, reduced to a balance of 0, and the CRAs were send UDF indicating pays as agreed/never late!


    BTW, on the email, I cc'd the BBB of NV, the AG of NV and the FTC.

    Very simple solutions to problems with FNBM! :)
