OK, Ill take a deep breath and try to calm down. I had an account with Beneficial in 1997, I never ever paid it. SO it charged off. 4/00 and it was paid in full and refinanced into another loan with Beneficial, which has been all paid in full. So it USED to say Paid Charge off, $0 balance, $0 past due. Well during my disputes as expired/obsolete, they updated it as Closed charge off (Not paid) with a balance of $4439, Past due $3780. I called the local office three times because the number on the credit report was a nonworking number. Each time they tell me "O well, dispute it with the CRAs," and I have, twice. It keeps coming back verified! I owe nothing on this account. I have sent two nutcases and the first verif letter and have been ignored. I am too through! I am going to fax the estoppel, and hopefully I will sue the lights out of them. I am so mad!!!!!!
Folks you only have 2 choices. 1*Don't do business with any of them and avoid this sort of crap. 2* Do business with them and get screwed over like this.
Was doing business with them worth this hassle? If you had known that this was going to happen would you still have done business with them?
Of course I know now, I dont know what I was thinking THEN! I am too heated, but after I sue, I'll bet I'll be fine!
Have you tried contacting the corporate office and talk to a consumer advocate there if they have one? They are usually alot nicer than the people on the front lines. Try sending the son of nutcase letter and adapt it your situation. I have written and PsychDoc has edited it to make it sound alot more professional. Try to send it signed by a notary to make it look more official. Have you tried the intent to sue letter? That might work also. It is better if you fax this though. Then send the follow-up to nutcase then file if you have to. You will need to show that you tried to fix it by all means. But by all means try to think rationally. Credit repair is not a straight road. You will mountains and valleys to deal with. But over the horizon is your clean report. I am not there yet but pretty close and you really need to have perservance and be determined. Stay focused. Give yourself a break if you need to. It's to say sue but when you're heated you are not thinking rationally. Been there, done that!

OK I calmed down a bit, and collected all of my data and wits together. I am faxing an intent to sue letter. The guy who I spoke to on the phone is the same guy who signed for my nutcase letter. The same guy who "couldnt find" the number for headquarters when I called him. I called the headquarters after locating another local office and asking them, they located the number in a minute or two. I called HQ and they said they would call me back this afternoon after they investigated. I called on my cell phone to leave a paper trail. They have not called me back. I am mad but I do have a paper trail and all my green cards lined up in a row. I have a copy of my credit report 4 days after they signed the green card that does not state the account is in dispute. Got 'em there. The account is being reported wrong. I guess I will sue, but I will take $1000 and deletion instead. (BTW, this account is supposed to fall off on its own 10/03 if it is a paid charge off, by reporting a balance they are going to extend it more time). Thanks everyone for the reassurance and direction. A little chocolate and Im more focused!
Just a little input, before you file your suit, pull one more report to make sure again that it isn't showing as disputed. It can sometimes take several days for that show up. Don't want you to include something in your lawsuit that may be wrong. So, just double check the day before you file.
Well it is now because I called Equifax on monday and asked them to dispute again. Should I hold off sending the letter to beneficial?
It is showing as consumer disputes - investigation in progress, or something to that effect. If the ca had reported it as being disputed it would say something like "consumer disputes - satisfies FDCPA rules". So, if that is not showing, go ahead and attack.
Thanks for your reply. It does say "Consumer disputes" so I will stick to my faxing on the sue letter. BTW, after I faxed the letter, 15 minutes later I finally get a call from the Branch Manager asking to talk. I let him speak to my voice mail. Only in writing from now on!
In previous posts, lbrown has promoted the idea that we should put FICO, the CRA's and all businesses using credit, or reporting credit, out of business. We should do this by refusing to buy cars, houses, etc on credit, and not renting apartments. We should also not have utility accounts, phone service, or car insurance. Then they would all go out of business. I believe that is the point he is trying to make here. I keep telling him I refuse, because I would have to live in a cardboard box in someone's driveway, or move to Montana and live off the land. But, I guess he thinks he has likely candidates for his campaign here on this board, so he keeps posting comments like these to support his idea of battling the credit establishment. BTW, I believe there are (at least) two people posting under lbrown's account, because, at times, there seems to be a big discrepancy in the ideas, and their presentation.
1*It's high time consumers acted like they had some back bone.It's our money and we need to stand up and start calling some of the shots. 2* This is where it's headed anyway and has already happened to thousands of folks who have had their credit trashed or ruined financially by the corrupt credit industry. Many folks will stop doing business either voluntarily or by force.
Just wanted to post my update..... I got a letter in the mail today from Household. They are deleting!!!!! I am so happy. Now, just Capitol One to go, and Mr. Cooke has already promised results.... Thanks guys!!
