I made a huge mistake, Help

    We were just prequalified for an investment mortgage. Thanks to all of you fab people I had finally gotten our credit in the ballpark. Problem is I have this account with Colorado prime ( DO NOT EVER DEAL WITH THIS COMPANY> BIG MISTAKE). I have sent some complaints letters to the company about the value of their products, and never heard a response. They changed thier finance company while I was paying this 1800 debt. They left the old account dormant on our CR and then opened a new account with Shoppers Charge Account as the name. I disputed the old account to get them to close it because I had this balance twice on my reports. Finally I paid this account off last month. Now they report a late 30 days on EX and TU. I was not 30 days late. i called a moron who told me that this is accurate and by law they cannot change this. This is on My DH CR and he never signed a thing. I am afraid to send a goodwill letter because they are jerks and i will be admitting wrong. Please give me some insight. Should I threaten to sue or what? Any ideas on how to proceed. i do not want to make a mistake.

    Send nutcase #1.

    Ask again if you cant find it.

    Do you think this is the best because they have ignored everything that I have sent in the past. I would love to sue them.

    If you can prove in court taht you were never late with a payment, sue for $1000 under FCRA provision requiring reporting companies to report accurately, AFTER tou dispute with CRA TWICE!! They will have to verify twice that you were late and if you can prove you weren't then sue under 623(a)(1) and 623(a)(2).

    I don't think you need prove anything. They have to prove that you were late!
    All you need is a a folder full of Letters that you sent with certified mail (return receipt).
    But I don't know what you have sent so far. So if you can tell me what kinda ammo you got I'll try to help you.

    Whole idea behind the nutcase letter is making them believe that you are going to sue. If the first one doesn't work there are two follow-up letters.

    This is what you do. Send Validation to OC with CMRR, online dispute as soon as you get the green card back(Return receipt). If they(CRAs) verify , ask them how they verified it, meaning request procedural evidence, usually with an intent to sue, hell send them small cliam papers with it as well. Meanwhile send nutcase letter 2 and 3 or Estoppel letter to OC.

    The only letters I have sent pertain to lack of service and value. I did complain once over the phone that they had put this account on our cr but had not updated the first one to show that it was closed. I hope they are not trying to retaliate against me. i already sent the nutcase today as soon as I got a reply.

    As long as the balance is 0 a 30day late shouldn't stop you from getting a mortgage.

    This is a very low interest and down payment 5% which is low for an investment.
