What subsection of the FDCPA says a CA can not pull hards before validation? If not based on law but on case law, what cases specify that? 3. While I agree that it is a OC/CA's burden to prove a debt, many small claims and State courts see it differently. Especially when asking a judge to enter a judgement AGAINST a creditor one better have all their ducks in a row 4. If we are only talking about an ITS and not filing suit you can disregard all the above. An ITS is similiar to a Nutcase. It is not always necessary to be logical or right. All you have do is convince the CA to want to end the issue.
