I have a lump sum judgment against my former spouse. Where can I legally run a credit report on him? Thanks!
you can try writing to the CRA's and include a copy of the judgment against him and see if that will suffice. you *typically* can't get a report on another party unless you are a subscriber but since you are a *collector*, so to speak, you may have permissible purpose. have you asked the courthouse to get you a copy? other than mere curiosity, is there some reason why you want it? are you having difficulty locating them?
Have you tried using WWW.KNOWX.COM to find the person? It won't give you a credit report but it gives you addresses and other info for a fee that you can't normally find just searching phone directories and such.
NO NO NO!!!! DO NOT "RUN" a credit report to collect a judgment! If you need to "find" someone, you can search all kinds of sources on the net. A recent case= A family hired a private investigator to "find out" about their daughtors new boyfriend. The PI ran a credit report and found the new boyfriend was a financial scumbag..... Well, the PI had to pay 50K$ to the "scumbag" boyfriend for impermissible access
Read this---- http://www.ftc.gov/os/statutes/fcra.htm#604 FCRA 604 spells out the permissible purposes.COLLECTION OF A JUDGMENT is no included A judgment is NOT a consumer transaction or consumer debt. Kinda the "standard"
Thanks much for the link, Mr. Hiding. Either I can't read English, or this is a typo, or I'm cross-eyed. Which is it? 604 (a) (3) (E) intends to use the information, as a potential investor or servicer, or current insurer, in connection with a valuation of, or an assessment of the credit or prepayment risks associated with, an existing credit obligation; or Ummmm..... when is "prepayment" a risk? anybody? Can't the FTC post the actual language of the law without a typo, or am I completely missing something?
-I just found comments about this. According to at least one court, A CREDIT REPORT CAN BE USED TO COLLECT A JUDGMENT. "Like other creditors, judgment creditors may utilize § 1681b(a)(3)(A) to access consumer reports. We think the Federal Trade Commission's (FTC) commentary is persuasive:A judgment creditor has a permissible purpose to receive a consumer report on the judgment debtor for use in [*5] connection with collection of the judgment debt, because it is in the same position as any creditor attempting to collect a debt from a consumer who is the subject of a consumer report.16 C.F.R. Pt. 600, App. at 509 (2002)." Hasbun v. County of L.A., No. 02-55495 , UNITED STATES COURT OF APPEALS FOR THE NINTH CIRCUIT , March 3, 2003, Submitted * Pasadena, California* This panel unanimously finds this case suitable for decision without oral argument.
