Ok, all. I have a chargeoff of my TU dated 8-2002 which is correct. On my EQ & EX it shows CO date as 12-02. I remember making my last payment 3-02. Can anything be done about this?
no jlynn, that is something I was wondering about. Since it shows 12-02 on 2 of them and 8-02 on one of them, I wasn't sure how to proceed. Won't it just be validated?
Ok, who is reporting the TL? And maybe it will be changed, maybe not - its all a crapshoot! Boy, I jumped the gun too. You realize if you start disputing, you may wake them up to start collecting from you? Need a little more info, 4 months may not be worth the risk at this point in the game.
But Jodi, I understood PSP to say "I remember making my last payment 3-02". Waking up a sleeping giant doesn't appear to be at issue. Actually paid accounts that are long ago closed but reporting inaccurately are the most fun. lol PSP you may have read somewhere along the lines something to the affect that by proclaiming their reporting is not accurate, please correct immediately, WITHOUT EXPLAINING WHAT IT IS THAT'S WRONG, should compel them to pull a CR to see what they are reporting. Once this happens you now have a violation, which is then used to force a deletion. Have you studied this strategy? ??? If not I'll try and dig up the threads.
Re: Re: I need a little help!! Dig you Butch.. that is something I will use in the future.. thanks for bringing it back up.. I love it
Re: Re: I need a little help!! Sigh, I have a cold, its raining, and I've been called a troll. I guess I'm a little paranoid about giving wrong info this morning, so am bending over backwards. Butch, please dig up those threads, I would like to read them too. SORRY PSP!!!!!!!!!
Re: Re: I need a little help!! Thanks PSP! Cap One is notorious for not charging off when they are supposed too. (I think Fed banking law directs this). Have the sicced a CA on you yet?
Re: Re: I need a little help!! Oh yes!! I have an offer from them (CAP 1 not CA) to settle with them for 50%, but the deadline in the letter is today! Any suggestions?
Re: Re: I need a little help!! Thats a toughie. I have heard that Cap One is absolutely the most difficult to get off your reports, and will only bump you up to an R5. Are you trying to buy a house, or are in a rush for other reasons. Is it a really large debt that you are concerned they will sue you over? What is your ultimate goal? At the very least I wouldn't settle without a letter that says you are paid in full. I could be wrong, but I believe it is Cap One that will take a partial settlement, and somewhere down the road have a CA try and collect the balance.
Re: Re: I need a little help!! have to argee with jlynn on here.. Do a search regarding Capital One.. They are horrible to get behind on and try and make it right with them.. They will charge horrible interest and late fee's.. the will not report correct info the CRA's.. they will take a partial payment.. that was said to be for settlement. then you check your report.. and it says you still owe, seen this happen even with a letter from capital one.. or that your 500 payment on the 1500 bill.. the CRA's will get 1000 Charge off.. They are horrible..
Re: Re: I need a little help!! nope, no hurry for anything. I've got my reports clear except for this one and a CCB chargeoff last year. Both due to DH's 30% paycut and my having to take 6 months off for medical reasons. I'm self-employed.
yes, jlynn, you are anything but a troll!! I hope you feel better real soon!! Butch, do you have any extra thoughts on how to deal with this, since it is an unpaid chargeoff?
Well ... there's a number of issues working against ya. It's recent, it's a CC and it's Cap 1. Knowing what I do know about cap1 I'd try to deal with them (Mr. Cooke) and see if they would change the TL in exchange for pmt. He will probably refuse. The secret to dealing with Cooke is to give him a good reason to see things your way. He has to justify what he does to his superiors. In other words even if he WANTS to help you he can't without a reason to. I got my adjustment from him because the co. failed to bill me correctly. Is it possible for you to develop this argument? Would he buy the argument that: I thought this was taken care of I want very much to do the right thing Cap1, for whatever reason, didn't process my change of address, which WAS mailed in. We've been a cusotmer for a while now, would you consdier making a one time courtesy adjustment? Etc. Failing that, and depending on the amt. I would have to consider filing suit for reaging the acct., and then use that as leverage to get my adjustment. Do NOT just bounce into Validation right now. It only gives them a chance to correct the inaccurate TL, and you DON'T want it corrected, (unless they fix the lates) you want it deleted. Have you ever asked them for a one time "goodwill" adjustment before? This one could be tough PSP. One things for sure, you don't want to live with the derog until 2008. Start with TONS of sugar here first. They basically have the upper hand.
Butch, there is an odd situation at play here. My son had an old friend and her brother stop by unexpectedly one weekend while he was home from college. His friend had a guy with her, and while we were out one afternoon, the friend stole my Cap 1 card and $50 dollars out of my wallet. We woke up the next morning, and the boy had split and left the kids there. I didn't report it to the police, but I did report it stolen with cap 1. I just thought it odd, because this happened in Dec 2000.
