Below is my Cr from EQ. I originally thought most of this was to fall off this year. After looking again it appears most won't fall off until next year. I need help on how to proceed, I'm totally lost. Help!?! I've read through postings here but I'm unsure how to apply them to my situation. Problem is, these debts are so old, I haven't had many if any CA's try and collect in at least a year. What do I do if I don't have a CA to send a Validation letter to? Do I go after the OC?
It's is very likely a CA is the one who is reporting the data on your reports however it could be the OC. You'll need to pull all three reports and get the info of the company (OC or CA) who is reporting each TL you wish to address.
Above I posted my EQ report. There weren't any mention of any CA's on it anywhere. Wouldn't that mean the OC's are the one's updating? Or am I missing something?
This is what I'm thinking: I send the OC's modified validation letters saying Im in Full Dispute. Once I get the receipt, I file disputes with the CRA's as 'not mine'. If the debt is verified and not updated as 'in dispute', I have the OC on a FCRA violation. Most of the accounts are set to fall off this year or next year. Perhaps you should let sleeping dogs lie. What is the sol on these accounts?They may be uncollectanble?
Haven't dispued with the CRA yet...should I dispute with them before the OC's? From my understanding of the thread I linked, which could be very wrong, I should dispute with the OC first and then the CRA. If the CRA verifies then but doesn't update as 'debt in dispute' then I have the OC for a FCRA violation, which I could then use to sue. Should I try the CRa's first and see what I can get them to delete before doing this process?
first i would dispute with the cras. begin with the oldest accounts.one or two at a time.diffrent accounts with different cras.there are two reasons i would start cras 1) the accounts are old and the oc/ca may not verify the item. 2) if the oc/ca verify and THEN and have no proof when you request it, this adds to your case in having it removed,and could add to a possible lawsuit for damages.
Like i said above the first thing he needs to do is find out the sol for all of these accounts. He can get that information from whychats site. Also the accounts are going to fall off on their own some this year and the rest next year.

The SOl is 5 years in Illinois(where I am) on Open accounts. I believe all of these are open accounts. Do the accounts fall off by Open date or Last activity date?
Ok, re-checked the FAQ. By my count 1 will fall off this year, the remaining will fall off by middle of next year. Should i just let them be? I'd prefer to hasten their demise but not at any substantial risk to actually lengthen their time on my CR. I'm confused. *goes off to read more*

Re: I need help. Don't know where s TheeOne, in my experience it never hurts to dispute with the CRA's. In most cases I don't think they check too much into it and often will just delete them (especially TU from what I've had happen with hubby and myself - we've both got clean reports with them now). Once in a while you get a stubborn account like we have with BofA that just won't go away, grrr........ But most of our baddies were about the same age as yours and I've had a lot of success with disputing with CRA's. I'd leave the OC's alone and let sleeping dogs lie if you've got nobody bothering you for collections.
ILLINOIS - I'AM FROM ILLINOIS! STATE MOTTO---IF IT IS FUN IT IS ILLEGAL! the clock starts ticking when you become deinquent and never get the account current. i would dispute asap! tonight,on line if possible.keep copies of your credit reports incase someone tries to re-age the account(s).
Ok, So I'll start by disputing with the CRA's and see where that takes me. Print out copies and keep of current CR (Just in case) Won't touch the OC's at the moment. Thanks to all. Any other suggestions?
