I sent a val/c&d/dispute letter to simm assoc. Feb 8, 2003. Got a call on my answering machine today (I was attending my grandmothers funeral) that said I need to call them Immediately,in regard to the letter they received CRRR. They said they couldn't answer ANY of my questions until they spoke to me on the phone. This is for a CCB account charged off on 8/02. Don't I now have them on a violation, and should I for ANY reason call them back? Please help me out with this, as all my old accts have been past SOL. Thanks, Patti

If they won't validate except by phone and you won't talk to them on the phone then they can't validate can they now?

but in your opinion did I do a major screw up by sending this while it is still so new? What I was hoping was they would send it back to CCB and I could deal with them.

If you sent a C&D then they should send it back because there isn't much they can do.

It's never to early to request validation.

You can't demand Val, too soon.

This could happen yet or even better the CA could end up eating the debt and paying off
CCB while you get both the CA and CCB listings removed from all of your reports.
Just let the Val. follow its' course.

It sure is hard to ignore those phone calls, though, making it sound like life or death!!

    psp,

Sorry to hear about your grandmother. Did you ever find out what your options were since they weren't licensed in your state?

It's a lot easer when you realize they are solely for the purpose of deception.

thanks Nik & jlynn, and no, jlynn I haven't found out anything yet. Why Chat told me the account would have to be transferred or sold to a CA that can collect in NM. And thanks, LB, I'll try to remember that good advice, nothing but deception!

Yes, but don't ever call them. Twenty five days or 125 days. Don't make any difference. Don't call them back. Keep a record of each of their phone calls Time, date & everything. And if they catch you in the house you can answer it and ask them all the questions I have outlined in a couple of other threads and then once you get to the end tell them that if they have anything to say to you they need to put it in writing and send it to you by mail. Then tell them adios and hang up on them. And if they call again do the same exact thing.

And don't just sit there at the end of 30 days. Keep pushing them. Don't give them any rest at all.

    Hi all,
This guy is persistent!! He called again this afternoon and left a message stating he MUST speak with me! Maybe I've got a screw loose, but I thought a C&D meant no contact until they validated. Am I wrong, or is he violating all over the place?

I wouldn't call! I disputed some past due medical bills on my husbands report and one on mine and both collection agencies were insistant on talking to us. I didn't call and all are now deleted. It is a ploy to see if they can get you to say it is your debt while they record it. They either can validate or not and that is that they do not need additional info! Just my opinion but not calling worked for me! Stay strong.
