I need help with Equifax

    Their is a account on my husbands credit report that is not his. We sent a letter certified to the collection company asking for proof of debt in writing we never herd from them. Several weeks after the 30 day time period we did get copys off all 3 reports Transunion and Experian did remove it. Equifax did not. We sent all the documentation to Equifax showing that the debt was not his. Also all this was sent certified. After 30 days we still did not here anything from Equifax so he called them. He spoke to a supervisor and he said that they were still waiting for verbal comformation. He then asked don't you need something in writing and they said NO. On Sat the 15th of Feb. He did get a new copy of the report. They did not remove the entry. They have it as 0 balance paid. The account was asked to be deleted. The account was never his and it was never paid. It is to my understanding if Equifax does not recieve a WRITTEN responce within 30 days the enry has to be removed by LAW. What can I do now Legally? They had more than enouph time to take care of this matter. Also I did file a compaint with the FTC.

    If everything you have written is true and well documented, you may also want to consider filing a complaint with the small claims court as well. Sue them for multiple violations and willful no-compliance of the FCRA. That will get their attention.

    Be sure to send a settlement letter with your notice of service.

    THe response does not have to be written. Furnishers use many means of transmitting, including electronic.

    Your complaint is with the collection agency that verified an account that wasn't yours. Have you read any of the old posts that talk about validation of debts?

    What kind of settlement letter? We never gave them anything. we just sent a letter asking for proof of debt. He never got a responce. Nor did any of the credit bereaus.
    One other thing how do I file in small claims court ?what do i need to proove my case?

    The collection agency never responded. Under the law I know if they do not responde the credit bereaus have to remove it. So I have a legal right to do something, don't I?
