I've been trying to refi my 9.5 mortgage for about 2 years now. I'm currently under a Chapter 13 plan. My mortgage and arrearage(sp) is being paid through the plan. (Payroll deduct) I received court permission to refi. last year April 2003 ($140,000) The new mortgage company requested a payoff from Midland mortgage when they received it it was for more than the original loan price $140959.49 After getting HUD involved Midland sent a explained the payoff. In short (It included the arrearage) No mortgae co would approve me until the mortgage should current. I contacted my attorney and had him to file seeking permission to use my tax refund to payoff the arrearage. I received permission and paid the money. Today I received the updated payoff. It's more than the payoff I received on 8/21/03. These people have made it very difficult for me to get refinanced. I'm wondering if I can sue them truth in lending, (Anything). This is costing me money. Steve
i would ask for the payment history (which will show how much went towards payments, interest, etc) and a detailed payoff showing how much is principal, interest, escrow, fees, per diem (the amount of interest accrued per day), etc.... then you should have a better idea as to what is going on.
