I Need Steps & Info for .......

    I am IN TEXAS .....

    I need the proper steps for filing a lawsuit against a "CA Friend"

    What to say , not to say etc.

    It is for Small Claims or what?

    This is my 1st suit ....coach me ..baby steps....

    I am NOT AFRAID!!!!!

    Step 1. Get in your car LOL!!!!!

    Seriously, head down to the small claims court in your district. It may be listed as a Justice of the Peace Court. Its generally within your city, if you live in Big D or somewhere of that size, pick one out of the phone book and call them. They can usually look you up by zip and tell you which is correct.

    Then, get in your car :) They have packets with the forms and information you need.

    Since you are taking baby steps, you might ask when they are scheduled for hearings again, and maybe sit in for a few hours to get a feel how the Judge likes to run their court.

    Geez, something else I haven't mentioned, not sure if you know about.

    Have you checked with the Secretary of State's office to make sure the CA is bonded to do business in TX?

    If they aren't - they can't collect from you

    If they are - and you sue them and win, you can collect from their bond.

    When you or others have filed suit, for the CA$$$SH....
    do you cite the sections of their FDCPA FCRA Violations for how you arrived at that figure???

    Or just say slime-ball Ca owes me $5000 ..set me a date in court??

    Do you serve Slime-ball in their Texas Address or serve them in their Far North US Address???

    Do you name the Alleged Debt Collector also?? or Just SLIME-BALL CA ???

    I haven't filed suit, just went so far as to get the forms and do the research. In small claims you can cite multiple violations of the FCRA, FDCPA, or TX Business and Commerce Code (whatever you are suing under)

    First, you will need to contact the Sec of State,(TX) to see if they have an Agent of Service. Where are the letters originating?

    Umm, whats the difference here?

    GET IN YOUR CAR...
