i recieved a summons...what to do

    today i recieved a summons....it was not presented to me, it was presented to a friend who is staying with me

    the summons is dated 2/20/04, on behalf of the cca, working for discover bank

    summons states that i must respond in 30 days by legal letter, and that a phone call or a regular letter will not suffice

    where do i stand now

    i had previously sent all the letters regarding the ccas rights to collect on this debt, they responded in kind, and now are proceeding to court

    any help will be appreciated

    First thing first. go over to www.artofcredit.com and register to use the forums over there.

    You'll find a lot more help than over here.

    Respond by saying you dispute the debt, or the amount, or whatever.

    Where is the court? If it's local, go there and ask them for the forms.

    if i formally dispute the debt, does that only push off the court date, or does that send the matter back to the collection agency

    btw, im in california, and the summons states i owe aprox 1600.00

    Is it truly a summons...issued by a COURT? Or is it just a trumped up collection agency letter? Read it over carefully.

    I believe it is illegal to falsely claim that something is legal process when it is not.
