I am backtracking some info, and called our previous medical provider and did verify that two of these bills had never been submitted. I have PROOF that one of them KNEW we had insurance due to a previous billing just 7 months before. This one I sent a letter asking for it to be taken care of immediately and removed from all 3 CRA's. Onto the next one, I decide to call (after some Google searching and finding their name had changed), to make sure I was sending to the correct address. Well, Guess what? They haven't billed for that company since 1999, the billing date is 2/2000, they have no records of that. She said if I would fax the billing statement she could reconstruct (yeah right). I asked all three CRA to verify this info. I got back letters stating that THIS bill was verified. It could not have possibly been verified, there are no records. It is at a collection agency on two of the reports, yet appears to be the OC on one. It's not possible. Okay...get this, I just called the phone number that was listed with this...I simply asked for a mailing address, she put me on hold, got another lady, and asked again, and she asked why, so I explained I needed to send in a letter asking for validation. She said they wouldn't send me validation. I said I needed to send the paperwork, she asked why I couldn't do that verbally, and I said because I wanted it in writing....can you believe the nerve. Really ticked me off, and FINALLY she gave me a PO Box (maybe she thought I was going to go bomb the place). So now to write up another validation letter. And this company I am ready to go after....there is no possible way this has been validated, yet they verified it back with the CRA's. Am I missing something here or am I starting to see the light??? "So now to write up another validation letter. And this company I am ready to go after....there is no possible way this has been validated, yet they verified it back with the CRA's. " -Disputing is a better route. Go with the "reasonable investigation" standard. -See FCRA 623(b) and Johnson V MBNA its on here somewhere lol
According the "nasty" woman on the phone, I didn't send the validation to the right address. I called to check and they gave me the run around on just getting a mailing address. She even asked why I couldn't do it verbally! YEAH RIGHT, and then told me they don't send out anything. I finally got the address and sent a validate this debt to them yesterday. I know they can't.
