I think I'm ready to sue....

    Experian & TU or IC system

    Account in dispute under Fair Credit Billing Act

    Has been shown on my report since April...first began disputing requesting validation I should say in January....I have gotten 1 phone call in late May from IC System verbally stating what the amount in question is for after sending them the estoppel....after they contacted me via phone at my NEW JOB...I immediately sent a C&D and haven't heard from them....I think I should send 1 final letter, an intent to sue, I don't see any samples? Equifax has obviously removed the account...and TU just called me frivolous...ARGH...how should I procede...ALL SUGGESTIONS WELCOME thanks!!!!

    Have you tried filing a complaint with your states AG, Dept. of Commerce, or the BBB?

    I had success going through the BBB for the same CA. The account was marked as paid, but it still wasn't mine and they ignored everything I sent until the BBB stepped in. End result, account deleted.

    I know in most cases the BBB is somewhat unhelpful, but it's worth a shot.

    Why do they put in dispute per the fair credit billing act?

    Is that the CRA's way of ditching their responsibility?

    It doesn't make any sense that it would be on a credit report, the time to use the FCBA when something is billable still.

    Hmmmmmm, surely if they can use it retroactively, so can we.

    Curious though, a lot of posters have reported the same appearing on their reports.

    It's been reporting that way for months...regardless of the 30 validition time limit or my 15 day estoppel time limit...I believe they are in violation and have to remove.....no???
