I sent a fax over to Cross Country Bank in regards to an alleged unpaid charge off. I told them that I was filing a lawsuit and I included a copy of the complaint I filed today with the FTC. In the fax, I told them not to call me, but 1 hour after I sent the fax, I received a phone call from the collections manager. He gave me some serious attitude until I hung up on him. I have also sent them a request for validation via certified mail. Even though they will not admit it yet, I am starting to feel that I am getting somewhere!!

Do you have an unpaid chargeoff with them or not??

Also just threatening a lawsuit won't get you anywhere most of time.

And if you do file a lawsuit, I hope you can back it up.

Did you specifically ask in your prior correspondence that there should be no further contact? Did they call you at work? Do you have a witness to this abusive call? If you can say yes to all these, I bet you've got more willful violations to sue them for.

They say the account is unpaid. I paid the account in full April 2001. I have a letter that was sent to me stating the balance was settled in full. The only problem is that the letter was not printed on a company letterhead or signed. Now they claim I have an unpaid balance. I guess that's just another way the Cross Country Crooks get you.

Have you sent them a copy of the check that cleared their account? If they still refuse to cooperate head down to the local courthouse and file suit. Why Cross Country is still in business is beyond me.
