I thought I settled this

    I think that I have covered my butt, but I would be interested in some feedback from others about one particular creditor I have been trying to deal with.

    The debt is to a doctor from 2001 and 2002 which was charges that my insurance didnâ??t cover (though I have been disputing some of the charges). My financial situation hasnâ??t been the best for a year or so and while I have made payments on it, the doctors office has been harassing me for the balance and I went looking for a solution to get rid of them once and for all.

    I read a book called â??The Guerrilla Guide to Credit Repair: How to Find out Whatâ??s Wrong with Your Credit Rating-And How to Fix Itâ? by Todd Bierman. I followed one of the scenarios in this book and sent the doctor a settlement letter stating that I was disputing some of the charges (which I had been doing since 2001) and that because of my financial situation I was enclosing a check for a percentage of what he claimed I still owed. The letter stated that acceptance of the check would signify that the account was paid in full and that he would delete any negative reports he made to any CRA.

    The check was cashed last week so I thought I was done with him. Today I receive a letter stating that I still owe him the other money and that if I donâ??t pay in 10 days he will send the collection hounds after me. Am I in the right here? I have copies of my letter, as well as all of the documentation from sending it certified mail, including the green returned card. Is he just blowing smoke hoping to get more money out of me? Or could he push this further? At this point I feel like I should just ignore his letter and if I hear from a collector I will send copies of the letter, check, etc.

    Might depend on what state you are in, and what their laws on restrictive endorsements are.

    I am in Texas, and it has been my understanding that restrictive endorsements were legal in this state.
