They have been incorrectly reporting my birthdate for months now and they are claiming that they can't do anything about it even though I've sent them practically every piece of identification I have stating my real birthdate. They claim that a creditor is reporting to them that I was born 30 years before I really was born and that they don't know who the creditor is, but that I should call all of these creditors and ask them myself. Geez! Their lax attitude that they are KNOWINGLY reporting incorrect information on my report gets under my skin. Shouldn't THEY try to find out who is reporting this incorrect info. Rant off. Just upset that's all. What should I do? Any recourse against them?
Yes Equifax is CRAZY. Last week I was informed by them that I was also known as "name". I have never gone by anything but my given name!
I don't know what recourse you may have, but you could try quoting them from FCRA: § 607. Compliance procedures [15 U.S.C. § 1681e] (a) Identity and purposes of credit users. Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 605 [§ 1681c] and to limit the furnishing of consumer reports to the purposes listed under section 604 [§ 1681b] of this title. These procedures shall require that prospective users of the information identify themselves, certify the purposes for which the information is sought, and certify that the information will be used for no other purpose. Every consumer reporting agency shall make a reasonable effort to verify the identity of a new prospective user and the uses certified by such prospective user prior to furnishing such user a consumer report. No consumer reporting agency may furnish a consumer report to any person if it has reasonable grounds for believing that the consumer report will not be used for a purpose listed in section 604 [§ 1681b] of this title. (b) Accuracy of report. Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. (c) Disclosure of consumer reports by users allowed. A consumer reporting agency may not prohibit a user of a consumer report furnished by the agency on a consumer from disclosing the contents of the report to the consumer, if adverse action against the consumer has been taken by the user based in whole or in part on the report. I am sitting here stewing about this. It's NOT my responsibility to ensure they are reporting correct information. I am getting ready to call them and tell them to investigate ALL of my creditors and have them see which one is incorrectly reporting my info!
I think Equifax is the worst at screwing up personal info. I have been disputing my credit report for months now and got it looking pretty good. When our broker pulled Equifax all sorts of things came up that I had either disputed or had never even seen before. I called them to ask why this stuff didn't appear on the report I received and they informed me that it was all under my maiden name and I had only requested my report using my married name. I have been married for 9 years so anything that was in my maiden name should have fallen off anyway but no, they had been putting things on whichever report they chose including some stuff like judgements and repos for some delinquent in Salt Lake City that I don't even know. I asked them for a copy of both reports and they said no because they couldn't prove it was me. Well, HELLO, if you can't prove I am the same person than how can you provide this information to creditors? OOHH they make me so mad. I mailed them a copy of my license and SS card. I hope they figure themselves out soon. Kim
