    BTW:
Do you think the company will pay the judgement?
I think several of us on this board can put you in touch with a collection agency.

We're really much more alike than you think (if you know what I'm talking about). For my own case, I judged the possibility of getting $7k in one shot simply too risky and felt it might invite the defendant to pull out all stops to defend the action. I prefer to fly below radar for as long as possible, and I'll probably go back to the table for another $1k bite in a few months from now. I also figured that if small claims turned out to be unfriendly, then I could always give it a shot in state or Federal court and test those venues as well. I'm in no hurry as long as the statute of limitations is not endangered, and who knows, they might even pull again as long as I'm not yelling in their face.

I don't know. Let's wait until the appeal period is over and then we can talk about it in more detail.

You can still bring the action as long as it's within the two year SOL. However, your situation is quite different from mine and they may indeed have had a PP for insurance purposes. Without some written proof that they agreed to give you a quote w/o an inquiry, it would simply be your word against theirs and you would probably lose in court (unless they failed to show and then you might win). This is just my opinion. You might want to start a separate thread and get some advice from the insurance experts onboard.

Thanks for the props! Cuervo's on me. Frozen? Salt or no salt?

I'm shocked they didn't offer to settle out of court. I'll bet they pull your credit again when you try to collect the loot. Word your demand letter carefully and these idiots will fall into another $1000 screw-up.

Yes, I'll have one frozen, one on the rocks, one with salt, and one with no salt. Thanks!

BTW, I wanted to ask you another question. In one of your posts you mentioned that the 8th appellate circuit has cited the Gowen FTC opinion letter in affirming decisions. Well, I went to the 8th circuit online and did a search under "Gowen" but came up empty. I must be using the wrong database. I'd like to go to a law library and research all opinions that have cited Gowen (I'm in the 4th circuit). These opinions, regardless of the circuit, should help support the Gowen letter if it was ever challenged by the defense in one of my future lawsuits. Can you point me in the right direction?
