Hi All, HELP! Well, here I am back again, never let anyone say it's NOT a neverending process. My story: I got my house last year at 6.5 - 30 years. Just bought a used (new to me!) Honda Civic for 5.49% 60 months. Life is going well, I am out of debt, I am paying my bills, everything is dropping off my reports, I am finally at 680 and going up a point or two every month. I get a little notice from Experian, "Your report has changed!" I think, hmm, another point up, yay, let's go check! I go to check. My score has dropped 44 points. My heart drops. I frantically look and see what it is - what could it be?! I have been so good!! I have paid all my debts!! It's parking tickets? PARKING TICKETS?! From 1997, 1998, and 2000? 5! If I EVER got a parking ticket - I paid it! What? Plus, I have always had my correct mailing address on my drivers license - I have never even HAD a notice sent to me! I turn red. I promptly forget everything I had done and learned with respect to CRAs, CAs and OCs in summer of 2002. I call the CA immediately! They give me all the information and then ask me for my address. I just tell it to them without thinking. (oops.) Oh well, I just got my first collection letter from them today. So I am sending off my first dispute letter because apparently I am on my first 30 days. Now, for those who don't know me, I successfully beat a ton of PAID collections and got them off my accounts including library fines. (search for my postings) . I have never dealt with a first time unpaid collection - I feel like a newbie again! This is for under 70.00 and I have typed up my validation letter (below) and am ready to send it off. The company is AllianceOne and it's for city parking tickets for Multnomah County in Oregon. Anyone have a strategy? I can't pull up bank records to prove I paid just yet - BofA charges a HUGE amount for to pull up photocopied checks PLUS I would have to know exactly the number and this was for YEARS ago. So far they are only reporting to Experian, Equifax and TransUnion still show me high and reporting all the stuff that's supposed to be out there. ______LETTER________ To Whom It May Concern: This second letter is being sent to you in response to the copy of the enclosed letter to me, dated February 28, 2003. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested. There are notations on my credit report regarding the alleged debt; I remind you that pursuant to the FDCPA, Sec. 809 Validation of debts [15 USC 1692g], that until validation of these debts is obtained, â??the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.â? At this time I will inform you that if your offices have reported or continue to report invalidated information to any of the 3 major Credit Bureauâ??s (Equifax, Experian or TransUnion) this action may be interpreted as collection activity. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you and your client for the following: · Violation of the Fair Credit Reporting Act · Violation of the Fair Debt Collection Practices Act · Defamation of Character This letter is NOT a request for â??verificationâ? or proof of my mailing address, but a request for validation made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. If your offices are able to provide the proper documentation as requested in the following declaration, I will require at least 30 days to investigate this information and during such time any collection activities must cease and desist, including placing any information regarding the alleged debt into any repository of any credit reporting agency. I would also like to request again, in writing, that no telephone contact be made by your offices to my home or to my place of employment. All future communications with me MUST be done in writing and sent to the address noted in this letter.
