I was served on Sunday September 7th 2008. I have called the attorneys to try to work out a settlement, they have offered 60% off the 2340 I owe. I cannot afford this as I make very little money and am on a bare bones budget. This account my original credit limit was only 1200 and I paid that down to 700 before I stopped making regular payments on the account. Basically this is mostly interest and fees. I offered 700 (my entire savings) and was yelled at told I was irresponsible. What do I do? Advice would be greatly appreciated.

Try that offer in writing, besides that check with your local courthouse and see if a lawsuit has been filed. If it has prepare to defend yourself. You can show that you have tried to settle the account.

I'm going through the same thing with Discover....

One thing is that their attorneys LIED to me. They have been telling me that they won't even communicate an offer of settlement to the client that is below 80% of the total balance. They stuck with that for a while until I got a lady who agreed to submit my offer which was about 30%. She told me she'd get back to me the next week. I waited three weeks and called her back. They told me that she no longer worked there and that she had NOT, in fact, ever submitted my offer...and that they would never submit an offer for less than 75%.

I know this won't make you feel any better, but they are absolutely the hardest creditor I have tried to work with. But, for me, I'm at least glad to hear that they came down to 60% with you.
