I'm caught in a circle

    Hello, I hope to better understand how to get this tradeline deleted.

    The OC is listing the trade line and assigned a CA to collect. If I request validation from the CA is the OC required to mark the trade line as 'in dispute'?

    The account is mine but amount is wrong. The OC verify's the bad information to the CRA's and after 2 letters to the OC they respond with all communication must be through the CA. I've sent the CA 2 validation letters well within 30 days of first contact. I've gotten no response. Any ideas for a next step?

    FYI - the trade line is a charge off of about $300

    Any dispute or request for validation needs to be sent to the entity that is listing the TL. Any letter from the OC to the contrary is incorrect.

    You could always offer to negotiate with the OC to pay the balance for deletion.

    The FACTA amendments to FCRA give you the right to dispute with any data furnisher, including the OC. FCRA also gives you the right to dispute any reported information thru the CRA.

    If you disputed timely (within 30 days) with the CA, then they cannot attempt to collect until they provide validation. Have they sent anything? Have they continued collection efforts after receiving your validation request?

    If it is in error, and you have already disputed thru both the CRA, and directly with the OC, with no response, you could proceed to sue under FCRA.

    What type of account is this?
    What is the nature of the error?
    How can you show that it is an error?
    Is the reason you have not paid the account that the amount they were billing was in error, and they repeatedly failed to correct it?
