In continued string of newbie questions...I have the serving agent from SOS, I have typed up my case and I can file small claims court via online... so now what...how do you get the registered agent served or is this an automatic thing?? I do plan to send an intent to sue letter to CA, with that do I include the small claims doc I have typed documenting what I am claiming as violations(giving them heads up), is this doc placed on small claims form (Just big white space) or is it more generic like "sueing for fdcpa violations" Sorry for so many questions...pretty nervous because I feel clueless about this whole court business..if anyone would like to help me with my document please email me and I can send it to you. have you tried calling the court itself to find out the specifics on filing online? Don't be nervous.. be PISSED OFF!! be confident as well I almost had to go the same route and I would be curious to see what some of the help would be so if anyoen out there has some knowledge please share I think many of us would benefit Arigato
You are sending an intent to sue letter to them with the laswuit? What is the purpose of that? An intent letter is to notify them that if they fail to do what you demand, you will then file suit. Sending an intent with the small claims suit is illogical.
I have just read on several posts that when they send a copy of the claim that it lets the CA know you arnt joking.... would the prove it or remove letter be appropriate then??
Jen, you can send the intent to sue letter with a copy of the completed (but not yet filed) small claims form. You send it overnight or via fax and give them 48 hours to settle or file. that is what motivates them to settle ( sometimes).
