Just went to court Against AllianceOne CA on July 18,2002 for FDCPA violations for validation and multiple debts... Had two accounts paid the one cause they didnt validate the other.. they paid the unvalidated account,remainder on the balance that i stated was mine.. Rep stated in court that they made mistake and was changing.. Pulled credit reports today and those bastards put a collection for the remaining amount on the account that was paid in full... Ill be suing now for FCRA violations furnishers of information portion.... My intent to sue goes out tomorrow...
You know, I wonder how much of this idiocy can be blamed on "computer glitches" where they rely on the computers to do too much of the work? As I read more and more of these stories it makes me wonder if anyone in any of these agencies has the ability, or the permission to use their mind while doing their job. It doesn't take a rocket scientist to figure out some things, but yet they continue to screw things up. God forbid they just let a human use their brain while disputing and validating - and then after that issue is done, let them use it again to make sure the same mistake doesn't happen again. Can you go to the courthouse and pull the file for the other case you had and use that against the CA as well? Plus instead of waiting for the results to be sent by mail, if the file is back from the judge you can see what he ruled from the file.
small claims state the judge hasnt sent in his ruling yet.. when i sued the first time it was just for FDCPA violations.. when i sue again it will be for FCRA violations...
