Impermissible Access Letter....

    It occurred to me the other day that if you are not part of the solution, you are part of the problem.

    I have made my opinion abundantly clear about most of the "letters" found on these sights. I still beleive most are misleading at best.

    So, now I have decided since I have pointed out the problem, I will post A solution. It is NOT THE ONLY solution, but one that has worked IN FEDERAL COURT, which I would say is a good test :)

    Below is a letter to a "puller" of a consumer's report WHO THE CONSUMER ALREADY BELEIVES DOES NOT HAVE A PERMISSIBLE PURPOSE.

    Re: Access of my [credit reporting agency] credit information on [dates accessed]

    Dear Sirs:


    About [time] ago, I had a charge card with [creditor] . The account, # [account #] was [closed and settled in December, 2002- for example] I have learned that employees of [puller] viewed my credit report, on [dates of acccess], though I had no account or obligation to [puller or creditor] at such times, and did not give [pullter] authorization to view my credit report. As a informed consumer, I am very cautious when I learn that my privacy has been invaded.

    Please respond within 30 days and provide me with the following information:


    1. What purpose did [puller] have to obtain my credit report on [date(s)?

    2. Since [date of last pull], has [puller] accessed my credit information on any other times or from any other credit bureaus?

    3. Who (the name and title of the employee) at [puller] actually accessed my credit information and who at [puller] then saw my credit information, as accessed?

    4. What did [puller] do with my credit information, where is it stored or how was it destroyed?

    5. Did you send me any notices related to [puller's] access of my credit information or related to any actions by [puller] (if so, please provide me a copy of each)?


    6. If you determine that [puller] accessed my credit information by mistake or in error, what assurances can you provide me and what procedures have you initiated to ensure that this does not occur again?

    7. If you believe that [puller] accessed my credit reports for a valid reason, please send me a copy of all documentation of the permissible purpose.




    Thank you for your prompt response to these questions and requests. If you need more time to provide the above information, please let me know how much more time you need.
