To: SCMOMof5 I live here in SC and I read your thread on MedClr, my dilemma is this. Marlin Integrated Inc is on my CR concerning an acct w/ Peco Energy. Marlin has now turned this over to Gold Key Credit Inc in Key West, FL. How can they collect on this account if Marlin is not a valid co? I have agreed to pay Gold Key on an installment plan. Re: To: SCMOMof5 Sis, This is the scenario... Marlin bought your account. They are 'acting' as if they are a financial institution. However, when a company purchases an account that was defaulted on, they are accountable for the FDCPA. Everything Medclr, Marlin, etc. refers you back to NCO. NCO claims that they are in partnership with Marlin, Medclr et al and they report under those names and send mail under those names. Because they are a collection agency collecting for a 3rd party, this is illegal. They must act in their OWN name. I have reported Medclr to everyone under the sun. They are not responding per the FDCPA like they should. Anything sent directly to them is ignored. Even their website directs consumers to call a 1-888 number. That is NCO, of course. IMHO, this "company" is a front for illegal drug money laundering. But, they are in FL's database at this time, but the info there is even questionable. They operate through the CRAs using the PA address but they are not registered to do business in PA, so that is illegal. They are not registered to do business in SC. I am getting with David Szwak and seeing what kind of lawsuit can be filed against them and NCO. I am hoping the gov't gets involved and shuts them down as well. The more people that complain to the FTC (which you can do online), the more likely this hoax will be exposed. I also emailed the Corporations office in FL (Sec of State) and this was their response: The Division of Corporations acts as a ministerial filing office only. We do not track pending law suits, complaints, or reputation in the business community for individual corporations. You can possibly find the information you are looking for by contacting the Division of Consumer Services at 1-800-HELP-FLA. If you are calling from out-of-state, dial (850)488-2221. Their website is http://doacs.state.fl.us/~cs/. I haven't gotten around to calling yet. I filed a complaint with the Miami BBB as well. There is no quick answer to this. I will keep everyone informed on what I do and what I find out! Where in SC? I am in Greenville.

I have two accounts reported by Medclr on my report, and they're reporting one of them twice. I sent them validation letters last fall - they ignored. Sent another round a few weeks ago - before I found this board. I sent them to the Key West address and cc:d the BBB down there. They have reported the account (except the dupe) as customer disputes. I just checked the Secretary State of Ohio site http://serform.sos.state.oh.us/servlet/page?_pageid=56,62&_dad=porthope&_schema=PORTHOPE and they don't list anything like Medclr. What do I do with that information? Contact my attorney general or sue Medclr? Was there someplace else I needed to look to see if they were allowed to operate in Ohio? Thanks

Bump....any more info on Medclr??? This thread seems to have come to an abrupt stop. What's the deal? Are they legal or what? My dh has one Medclr acct that was deleted from TU and was supposed to be from EQ but found out today it remains. I call the # on the report, give the acct # and they come up with someone else's acct! Then they start asking me how the TL is reporting and send me off to someone else. I cant get anywhere with them. (the OC Acute Care is reporting on the TL, and also says it's 120 days or more late and is open...they're also charging interest). They're going to make us lose our home loan....this collection coming off EQ is the only contingency and we are supposed to close on the 29th!
If I EVER get a NCO/MEDCLR item listed on my reports, I'm going straight to an attorney. These people are idiots. The only way to deal with them is to sue them. Quit playing around sending letters that they will ignore. If you know the account isn't valid, take it to court.

Re: Re: To: SCMOMof5 My experience: Once I sent them intent to sue letters they stopped contacting us and stopped verifying for the CRAs.... their listings got deleted and I never heard from them again. They do not operate according to the law (gee what a surprise there!). They give you plenty to stick into an intent to sue letter. I have moved to FL..... I have found that although there are laws that Collection Agencies are supposed to abide by, FL has no organization that has the power to *enforce* the laws.... this is why Medclr, et al are located here!!!!
