Re: Re: Re: To: SCMOMof5 Good for you! =) It sounds like you didn't bother trying to "negotiate" or deal with these sharks by phone. Why bother trying to negotiate with a COLLECTION AGENCY? Your account has been sold to them by the OC & they don't care about you or your circumstances. All they want is your money and they will tell you anything to get it. The only time I would answer a phone call from a CA would be to say Don't ever call me again, don't call my job, my family or my associates. *click!* <---- And I would tape that call.
Okay, now I have found a collection from Assetcare on my EQ report...it's reporting $9600 paid (a telephone bill!!). The number on the report is a Michigan #, but is not in service...no address. It was reported 4/03. This same TL, with different info and a variation of the above acct# was reporting with TU as $96 (correct amount) unpaid (was supposed to be paid). I disputed it about 2 months ago and was deleted. This collection was reporting with NCO Financial! Report date 8/01. Soooo, can someone tell me if Assetcare is actually NCO financial? It seems that NCO goes by many names, is this CA one of them? I need to know who to call to begin to find out who has this collection account to get an address.
Re: Re: To: SCMOMof5 Can you explain what you mean by they (Medclr) must act in thier own names? I have both Medclr and NCO reporting my credit report. NCO has an address in Upper Darby, PA.
Re: Re: To: SCMOMof5 FDCPA: § 807. False or misleading representations [15 USC 1962e] (14) The use of any business, company, or organization name other than the true name of the debt collector's business, company, or organization. Medclr purchases defunct medical accounts. NCO collects for them using the Medclr name. NCO will tell you that they do not own Medclr or are owned by Medclr and Medclr with say the same regarding NCO. Soooooooo If NCO is not Medclr how can they collect under the Medclr name. They cannot. Also, Medclr is not in PA. Medclr is in FL. To do business in PA, they must be registered. They aren't. The list of violations goes on and on. The easiest was to deal with NCO is to threaten to sue. As soon as you do, they drop you like a hot potato. They are so guilty of violations that they are afraid to be taken to court!!!
ATTENTION SCMOMof5 SCMOMof 5 - thanks for posting this information, but can you help... I am trying to assist a friend of mine with her credit. She has Medclr listed. She disputed this in 2000 with EQ and it has a comment listed as Consumer Disputes this account information; Collection Account. She never asked MedClr to validate (which after reading, they will not). What do you think the next course of action would be for her to get this off her report? She is willing to pay the original creditor. But want MedClr off her report. Thanks!
