Today I received in the mail from a collection agency a print out of a "statement" with my name and mailing address and then it lists items ordered: 1-12-98 Charcoal grill 7-03-98 Grill topper 12-10-98 Barbeque fork * not shipped see reason below * back order This is ALL they sent me. Do I send another validation letter or wait the 30 days and send estoppel letter? I'm not sure what to do next?
That is NOT enough... That is as good as "WE HAVE YOUR NAME, ADDRESS, PHONE # IN OUR COMPUTER" and it says you owe $318.12...
So would Christi now send the green return receipt card along with a letter to the CRA that company x has not validated, and now demanding deletion?
No do not send them anything more than "Delete this inacurate entry/not mine" - you can include a statement of CA could NOT verify the debt. Sending them the proof you have will not help, and is not necessary. You are building a good case for a suit if they do not delete the item as this is not adequate verification. If you are prepared to sue I would begin that process at the same time you send in the next dispute. If you want (not to sue yet) to wait and see if they do not remove the entry from this next dispute after you received this inadequate verification, that is fine (and probably what I would do - give them one more shot to remove it) but you CAN submit the small claims forms and demand they remove it or you will see them in court if you wish. I still think a second shot at a deletion from a simple dispute is worth a try, and the more evidence of FCRA violations, and proof you tried to get it done the right way, the better. Drop the suit ONLY if you are ready. Make sure you keep a clear paper trail and evidence or FCRA the violations. Search for Marie, LKH and Lizardking posts to find information on suing the CRA's for FCRA violations in order to correct your report and force their hand.
