I have a CA that may sue me over a Providian CO for nearly $6500, plus the interest they added @ 23.9%, making the debt they are trying to collect over $9000. I am in AR, and have asked about this to a local attorney, and he said if I am sued -quote- "You never know what someone will do, but I think there is a good chance that the collection agency will not put forth much of a case. Remember, they will have to have at least one witness to testify. Without a witness, we can have case dismissed. They would then have to re-file, and if they fail to produce a witness the second time, their case would be forever dismissed." I was wondering if anyone has ever had their lawsuit thrown out for the reason of the plaintiff not having a witness?
