I just dropped 44 points due to inquires, and my wife dropped 46 (exp). All are related to "hard" inquiries from debt collectors. Are hard inquiries allowed for debt collection purposes?
Many say they are allowed to...even though you DID NOT "APPLY" for any credit cards or loans... I WOULD DISPUTE THEM WITH THE CRA'S~~"I NEVER APPLIED FOR ANY LOAN OR CREDIT CARD WITH THIS COMPANY...PLEASE REMOVE"
George, the FCRA also makes a point to say a pulling a report for collection purposes in a permissable purpose.
Re: Re: Inquiries ...BUT WHAT DO YOU GET WITH A "HARD" THAT YOU DON'T GET WITH A "SOFT" OTHER THAN A LOWER SCORE???
Re: Re: Re: Inquiries I absolutely can't imagine a C/A is allowed to pull a "hard" report every day, or once a month, when trying to collect. Geeze, even DIS only pulls soft reports when doing background investigations. So what's to prevent them from "permissably" pulling a hard report once a month, forever?
Re: Re: Re: Inquiries perhaps we need a better definition of "hard" and "soft". I was under the impression that a "hard" report was authorized by the consumer seeking credit, whereas a "soft" report was permissible to credit-granting or other agencies that were trying to drum up business.
Re: Re: Re: Re: Inquiries A "HARD" is when "YOU" apply for a credit card or loan... A "SOFT" is when a "COMPANY" is looking to drum up business... Since you DID NOT apply for anything with the CA...it should be a "SOFT"...
Re: Re: Re: Re: Inquiries okay...after some research... 603(m) Appears to allow Creditors to procure the report based on the definition below. Credit or insurance transaction that is not initiated by the consumer. The term "credit or insurance transaction that is not initiated by the consumer" does not include the use of a consumer report by a person with which the consumer has an account or insurance policy, for the purposes of (1) revieiwing the aco**** or insurance policy; or (2) collecting the account. 604(c) Appears to limit the reporting agency from reporting "soft" inquires. However, 603(m) doesn't expressly allow reporting of "creditor" based inquires, nor does 604(c).
Re: Re: Re: Re: Inquiries Did you see this section? § 604. Permissible purposes of consumer reports [15 U.S.C. § 1681b] (a) In general. Subject to subsection (c), any consumer reporting agency may furnish a consumer report under the following circumstances and no other: (1) In response to the order of a court having jurisdiction to issue such an order, or a subpoena issued in connection with proceedings before a Federal grand jury. (2) In accordance with the written instructions of the consumer to whom it relates. (3) To a person which it has reason to believe (A) intends to use the information in connection with a credit transaction involving the consumer on whom the information is to be furnished and involving the extension of credit to, or review or collection of an account of, the consumer; or
I just recently had this same argument with myself. I lost as usual http://consumers.creditnet.com/stra...5&perpage=20&highlight=inquiries&pagenumber=2
