I had Allied Insurance company inquire about my credit record or score . I never signed one thing giving them this right . Do they automatically have the right ? Toolhound
You don't have to sign anything. In most states they have to tell you they're doing it, in a few, they don't even have to tell you. Only one state requires a signature - can't recall which.
I called around for estimates in June when I bought my new car. Farmers ran my credit AFTER I asked them if they were going to. They never mentioned it and she told me no. It took them 3 weeks to get back to me with the estimate when they were going to call me the next morning. I raised hell with the district mgr. who claims they sent a request to TU to have it removed. It still hasn't been. I gave Farmers the fax # for TU and she claims she couldn't get through. She then sends me the fax for TU and says "good luck getting through". As if it is now my problem. I faxed it in. But if I have even 1 tiny problem with this, they will get an intent to sue letter which I have already written.
Thanks for the info . You seem very knowledgeable . I feel that if I rock the boat they will cancel me and then I will be hurting with bad credit and no insurance .
LKH, you live in a "credit" state - the insurance companies don't even have to tell you they're going to pull it. §20-383 Lists the appropriate rate-making standards. §44-1692 Permits a consumer reporting agency to furnish a credit report to people it believes intend to use the report in connection with the underwriting of insurance.
But, I specifically asked if they were going to pull one and the answer was "no". (c) Intends to use the information in connection with the underwriting of insurance involving the consumer. That is exactly what it says. Now, does that mean they can pull it for an estimate of rates, or that they can pull it when writing the policy?
They can pull it for estimating rates - the quote. However, I believe that since they told you specifically that they would not do it, that puts it on another level. Many of them use software that pulls automatically - I know Nationwide just went to that. The agent has no control over it. You want a quote, your credit gets pulled. They should have told you the truth.
Yes they should have. Now Progressive, who I went with, gave me a choice. They could give me an estimate without pulling credit and if I didn't like it, they could then pull my report for another estimate if I have good credit. The quote without the report was sky high. I gave her the ok to pull my report. They pulled Experian and came back with a price that was more than $400 less.
