Okay.. here goes another matter so desperately needing the expertise of those who have gone before me and know how to handle such difficult matters. I had a federal tax lien against me. It was a huge amount. I went back and forth with the IRS until FINALLY I was able to get resolve. The IRS told me that this was a matter extending over 10 years and due to the statuate of limitation and the fact that we had been dancing around with minor reductions (frmo them) on what they thought to be owed for years that they were releasing me from all liability and considered this debt no longer owed or valid. YEAAAHH! Or so I thought. This was reported to the CRA by the municipal courts. I sent a copy of the IRS lien release letter to the courts. I heard NOTHING back. I sent a letter to all three CRA's. I have not heard from TU or EQ but Experian sent a letter with the following statement: A tax lien appearing on the credit report means that the government has filed a lien for past due taxes. The amount of the lien includes the original value of the lien. While you make payments to the government, the account status will remain as it appears now. Once you pay the account in full, it will show "tax lien paid". This will remain on the personal credit report for seven years from the date the lien was paid. An unpaid tax lien will remain 15 years." WELL!!! No kidding. But what about the fact I do not owe it and have sent them a copy of the letter to substantiate my relaease. When I try to call them their automation will not put me through to a human being it just says refer to the response letter I received!!! HELP!~ I need this OFF my bureaus. By the way, once deleted will this help my scores?
First, what exactly does the letter from the IRS state? Does it say "Release of Federal Tax Lien", or does it say "Lien filed in Error". This is important as to credit reporting. If it was filed in error, you will need something in writing from the IRS, and then you will have to follow it through the system. You should start the the "Tax Payer Advocacy" group, they are linked on the IRS website. You will be seeking a "Removal of Federal Tax Lien", which once processed, the IRS itself contacts the CRAs to remove. So, first things first, what documentation do you have, and what exactly does it state? Then as a note, be patient in this process, it does take quite a while. As to the effect on your credit score, it depends upon the age, yours sounds very old, so ironically, it is probably having a positive effect, adding more "aging history" points, than negative history points.
Thank bziwiz for replying to my post. I am very new to CN and indeed thankful to GOD for finding such a pool of experts in this regard. I might add I have been studying the suggested reading as outlined for those new to CN. In response, my letter from the IRS is a "Certificate of Release of Federal Tax Lien". It is stated as â?? I certify the following-named taxpayer, under the requirements of section 6325 (a) of the Internal Revenue Code has satisfied the taxes listed below and all statutory additions. Therefore, the lien provided by Code section 6321 for these taxes and additions has been released. The proper office where the notice of internal revenue tax lien was filed Nov 2000, is authorize to note the books to show the release of this lien for these taxes and additions.â? What specifically does this mean? When I have called the IRS they state they do NOT show a lien against me as if it never existed. What is the best approach towards the CRA? Can this be removed or will it remain for the next 15 yrs as stated by EXP CRA?
