an unsecured signature loan from a bank? Im currently about two weeks away from filing Bankruptcy and was wondering if I could throw in this loan I have with this bank that is an unsecured, signature loan? Will the bankruptcy wipe that out as well? My car was repo'ed, and the bank gave me an unsecured sig. loan to pay back the difference owed to them, and ive been paying on it recently, but just started wondering if my bankruptcy would wipe that out as well? Oh, ok, will it take care of a $5 check I bounced 6 months ago? IF not, how do I take care of such a measly thing? Im cant even believed it happened.........but it did........how do I go about remedying that? Yes, you can get rid of that loan. If the Trustee doesn't like the circumstances of the loan, he could void it, but then he goes after the company that got paid for the repo for the money, not you. If you have any accounts with that bank, you should close them before filing, though. Banks have been known to take money out of checking and savings accounts for this kind of thing, and while you could (with some legal expenses) get that back, why put yourself in the position of risking it.
I've read where you can include bounced checks in a BK, but have also read if you do that it is he** to open a bank account afterwards. Just my .02
I'm still curious...how many times have you heard about a REPO that didn't involve a non-payment? My gut instinct tells me that the bank found out about a misrep or a lie on the application. What the heck else is there? What happened?
I had my truck for sale at a local consignment lot. the loan officer that gave me the loan, drove by and saw it for sale there on that lot. She called me, asked me where my truck was, if it was in my posession, and then asked if the guy that owned the lot had the keys. I honestly told her it was on that lot, for sale, and that that guy had a set of keys to it, given to him by me, to show it in case anyone wanted to look at it. The loan officer then told me that was a direct violation of my loan papers, (it being in the posession of someone else not legally allowed to posess it) and that it was a risk to the bank's asset having it there in that situation. So she said they were reposessing their property and that I would hear from them at a later date..........thats BS if you ask me.........all my $$$ is out of that bank.......just $5 left in a savings account.........

If you can make good on the check, most states have criminal laws against bouncing checks and not making good on them. You could very well find yourself arrested and in jail, I can assure you a BK court can't help you on that! Tac
I never knew it was in "fine print" that your car would be re-possessed if you did not pay. I thought that was obvious.

By the way, I think its common sense the bank would deem someone who is not paying his car note, and then gives his key to someone else is a risk. By the way "impairment of security" clauses are not in fine print. Learn to read, and if you do not agree do not sign! I am such a moron, yea. Actually, the bank can reposses it for non-payment because they probably accelrated the balance of your loan, and you diod not pay it in the 15 days. Thus, repossessed for non-payment By the way, a bit of advise, pay you $5 bounced check (if you in LOuisiana its $125 now). Bankruptcy does not get rid of your criminal liability.
Not necessarily. Student loans are hell to discharge. Also, the bankruptcy court thinks you got a loan to defraud a creditor by just filing bankruptcy, your discharge can get denied. Once a discharge gets denied, that creditor can hound you for life. Thats because you could never get a discharge (ever!) on a debt where a discharge was denied due to "Fraud."
