Is Fax Reciept Legal In Court

    Does anybody out there know when you send a DV or Settlement Counter Offer via Fax, can you use the transmittal report in court that they recieved your docuement: I got the information below after doing some research, wanted to know for sure:
    "
    ...If you are faxing your validations, make sure your fax machine prints a transmittal report of each and every successful fax that shows the date, time, fax number and number of pages faxed. This is YOUR proof that the collection agency or debt collector (DC) received your validation request. "

    Don't know if this would apply, but I write a lot of contracts and in the T&C one of the items in there states that faxes will be considered legal documents. Once they sign off on it then I "assume" it is ok.

    It's legal, but it's not a slam dunk. Judges have said they are easy to alter.

    If the CA has more than one fax machine sometimes they'll claim you sent it to the wrong one.

    It really comes down to the judge.
