Good evening... I stumbled upon your board which seemed the perfect place to ask. Is it impossible or unlikely to emerge positively from disputing a reposession? Has anyone had any luck getting one off their file in any manner? Also am arguing with credit card companies from old write offs. Should I persue a credit card company much the same way I would a collection agency by sending a letter demanding proof of validation or remove? Are there any other useful strategies someone may have for disputing a credit card issuer like capitol one or the like? thanks all for any input!
I would always start the process with the CRA's take two accounts and dispute them on all three CRA's.. wait the month see what happens.. Then move on to the next two accounts.. and so on an so forth.. If they get validated.. Then I would go the route of sending letters and so forth.. Let them do the work at first, save your time and energy.. for those accounts, you will really have to fight to get off.. The repo can be deleted as well.. Best to wait as long as possible to start to fight it.. In my opinion as the longer you wait, the less likely the bank will still have all the account information on hand to validate the account to the CRA's.... Mine however was a repo, that I ended up paying the remainder of the account balance on once the car was sold. How much of a factor this was, I can not say for sure.. I've gotten my VERY recent (less than a year) repo off of my husband's and I's TU report and updated to a "paid never late" status w/ EXP. Still trying with EQ. As for the balance question, I would think yes they would have to report your actual balance due right now. They are reporting inaccurately. Me, personally, I like to dispute my negs as "not mine" the first time. If they come back as verified I then nitpick- try to find ANYTHING wrong.
I don't think it is. When my ex & I were arranging financing for a truck, the Finance manager said we needed to tell her the details of our repo. We we're like, "What repo? We drove the car here!" We had a few late pays, but still had possession of the car. Go figure. Anyway, disputed with CRA as paid, never late and TL was updated to reflect that. Good luck!

I would recommend disputing every item including the repo in one letter (as long as you have no more than 10 disputes in total). The CRA's are lazy and there is a very good chance that they will only investigate a few of your accounts and delete the rest. Doing onezie and twozie disputes is an almost sure fire way to guarantee that you will get a complete investigation on every item that you dispute. It also greatly increases the probability that your successive disputes will get rejected.

I can presume CRA workers are not all that highly compensated and the rigors or repetative work and basic overall apathy to a point where they pretty much don't care would be increased with a larger dispute. BUT what if I have like 18 disputes. Is that overdoing it? would that send up flags because of too many? seems it might. opinions?
Re: Re: Is it futile to dispute a repo?? Another question... IF the CRA deletes these out of unverifiability or just plain lazyness, doesn't the CA have the ability to come right back and tag the report again? or does the CRA permanantly bar that trade from being retagged to the file?
I agree with ryder...I did very big disputes my first round. EQ deleted 9 out of 11 (something like that) and two of those were repos. Got 1 repo off tu, but the other is stuck. They are falsely reporting that I filed bk in 2000. I did not. My ex did. SO...even though I didn;t file, they show that I did. It is such bs. My 94 bk is off my tu report, but now, according to chase bank, it looks like I filed on this account. The lady accused me of filing bk. I told her I did not. So, the fact that tu reports that I did is libel...dammit. Anyways, I know tu caved to that lawsuit that says they weren't going to report bk's for co-signers anymore. But, then I'll have a charge off, which I GUESS is a wee better than bk. At least your creditors dont accuse you of filing when you didn't. Will wait til SOL for lawsuit runs out, so I don't wake the giant, ya know?. Which, I'm not actuallly even sure what SOL is in this case. I know that WA has a 6 year sol on written contracts, but I know that repo of the car breaks that contract. So, I've got lots of homework if I want this bad boy off of there. good luck
I currently live in OK, so I am hoping to catch them with their inability to validate and hopefully be done with it. in OK, the SOL is 3 years. but the repo is reporting the wrong amount by several thousand dollars ssince they added all the interest to the amount up front and never deducted for when they sold the vehicle after repo. are these violations harsh enough to make them delete with a bit of pressure or are they not really a big deal? Well, when I do start the dispute I just would hate to lay over 15 disputes down at once, but it does seem logical to do it that way in a sense.
Also,is it harder to validate an onine car loan or does it really make no difference? my other half has a repo from a loan she got online through TransSouth. Im guessing it doesnt make much difference but thought Id ask if there were any advantages to this.
Re: Re: Is it futile to dispute a repo?? From what I've read, at least in some states, there is a separate SOL for the length of time in which they can sue for deficiency balances. TX codes that pertain to this hit on such keywords as "secured transactions" or collateral. Good luck!
Re: Re: Is it futile to dispute a repo?? I had a car repoed in March of 2002. It was deleted from my reports in August 2002. So anything is possible. It was to my advantage that I moved to a new address and had the old address deleted from my file.
Re: Re: Is it futile to dispute a repo?? Most of the large corporations I have worked for only keep old account infomation in their system for two years. After that, they have to manually pull records from storage. Of course, some companies keep info on hand beyond the permissable reporting period and use it to their advanatge on new credit applications. This is the "back alley" credit bureau, if you will. But I imagine this is more the exception rather than the rule. Remember, once the financial interest in validating the information is gone, so is their motivation to waste time trying to validate it.
