I'm trying to get the Associates National Bank to remove the lates on my currently closed "Pays as agreed" account but it is JUST impossible to do. I've tried EVERYTHING. Goodwill adjustment letter, credit repair companies (they would finally cancelled my account as this is the only derog I have), letter sent myself - NOTHING WOULD WORK! Anyway, I just started thinking. Maybe some of you know the details of Terms of Agreements, etc when applying for credit cards. I got this card (1st one) 5 years back while I was an International Student (meaning, I could not legally work, etc) on student visa. Later on I got my green card and will become an American Citizen in 2 years but that's not the point. I wrote them Goodwill adjustment letter saying I could not work and I finally had no funds to make on time payments but that would not work at all. Actually, it was a thruth but who cars! I'm trying to find out if it was LEGAL for the Associates to issue me a card at the first place. Does anybody know this? If it wasn't, I may have got them! Thanks for all the info. That's not the issue, the issue is if a person who will be leaving the country within months or years could be issued a credit card. If you come to the U.S as an International Student you are supposed to leave the country as soon as you finish school. At least you change you status somehow: work sponsorship, family, etc. Thank you for your reply but this is not what I'm asking.
I am going to be devil's advocate here... Why did you apply for the credit card if this is your feeling? Most credit card terms state that you have to have at least $15,000 in income coming in from somewhere, what did you state when you applied for income? To be totally honest, IMO, no this defense would NOT work.
no offense, but what is the issue...? Why wouldn't it be legal, CC issue cards to non-US citizens all the time, ever seen a Visa commercial during the Olympics ". . .and they don't take American Express"
When you apply for CC every credit card company ask you if you are permanent resident or US citizen. What was your answer ??? If you answered YES then you gave them false info and YOU probably violated the law. Don't even think about suing them.
Hold on, hold on! All I was asked to put on the application was my tuition fee, address and SS#, the guy said that should do it. It was at the campus. The reason I am asking is so I could maybe get them to remove the lates if they were not supposed to issue me the card at the first place. Now I feel like you are attacking me because I am trying to find the way to beat the system. Isn't it why we all are here? I see people lying to get the account that they owe the money on removed, and all I'm trying to do is get the late payment removed. I do not understand why some of you get offensive. What you are trying to say sounds like credit card company issued you cc illegaly and it's ok and legal if you don't pay your bills.
I know he paid it but not on time so it is against the agreement. What is illogical- he is trying to say that credit card company acted illegaly by issuing the card.
Sure, it is perfectly "legal". What you are asking is if the credit contract is enforcable. There aren't any laws that I am aware of that make it illegal for a bank to issue a credit card. The contract is enforceable if you were an adult (18+) at the time you signed it. Your residency status has no bearing on your liability. Unless I missed something, you did not lie on your credit application. I don't recall ever being asked for my citizenship on a credit card application. I guess that falls under "Don't ask. Don't tell". Fraud on the other hand is illegal. It is a crime. If they can prove that you lied on an application in an effort to defraud them, then you might be criminally liable too. Since Sept. 11, 2001 there have been new laws designed to tighten up control of non-citizens in the US, especially those with student visas. In the old days, defaulting on a debt did not endanger your visa. However, it might now. Does any one know?
All right, that's all I wanted to know. I paid it all off and have no trouble paying my bills anymore now. I did then, but I could not work so I could not pay my bills on time. Anyway, all I wanted is to get some advice on how to get the lates removed, because everything else did not work. I did not want anybody to give me an advice how to screw collection agency who I owe thousands of $$ and do not want to pay (which we see a lot on this board), so it just amazing seeing some of you getting angry that I'm trying to get the late payment history removed. Actually, I own a business and now have the ability to spend, but with this particular account with lates on my credit history my options are somewhat limited. Anyway, I thought that maybe this would be the way as I said nothing else worked. I'll probably have to find some other way. Thank you all for replies and I hope somebody may have some other solution to this problem.
You were an international student and had an SSN? I thought only citizens have those. Do you get one when you get a green card? Someone please enlighten me. I've always been a citizen, so I don't know these things.
I agree with you on that. Most on this board are trying to use our "legal" rights to correct our accounts...trying to beat the system. There is nothing wrong in what you are doing. As your last resort, I would participate in CHOD and see if those lates come off. )
rblues, I wanted to get a driver licence and was told that without SS I could not be able to have one. I went to SS office and was issued one. As far as I know it is not possible to do that anymore. Most of my family is here so I finally got my permanent residence and will become an American Citizen in 2 years Anyway, rblues, thanks for finally understanding my intentions.
Personally, I think what you are doing is EXACTLY what we all are attempting here, to use the law to our advantage, this is not illegal or immoral. But so very often a poster jumps up and gets on a soapbox (usually without understanding the question) and starts with a morality speech. I always wonder what they are doing here if they are perfect and never had been late themselves? Carry on and good luck. Find that loophole and jump through it, and just ignore the ignorant! JohnM
