Is it legal for credit card companies to store payors' bank information if a bill is paid by check and not through online payment? Earler this year - March - I paid my son's credit card payment with one of my checks. He gave me cash for the payment, I put it in my bank, and paid that bill. Between April and September he did pay on the card with money orders. Just recently I noticed that this credit card co. made an unauthorized withdrawal from MY account for my son's missed October payment. While I did get the withdrawn funds back from my son I am questiong the legality of this credit card to store banking information from checks sent to them. As far as I'm concerned the credit card co/their bank robbed me.
Whether its legal or not to STORE the information is not the issue. Its not legal for them to withdraw from your checking account period. You gave them no authorization, nor are you financially responsible. Regardless, and I don't know where to find it, but I believe they have to give you SPECIFIC notice of an automated withdrawal (of this type) before hand.
