I sent a DV to a CA a good while ago, they have not responded yet. Now they have started calling me. They were not calling me before I sent them the letter. Are they violating any laws?
If you sent the DV request with ine 30 days of Initial communication then the answer is: Only if they ask you for money. They are allowed to wish you a Happy Birthday.
Actually, they can't even call to wish you a happy birthday... Unless they're asking if the address to mail the $1,000 birthday check is still correct. Look at the commentary notes; even if the debt collector calls to 'chit chat' the underlying message is "Hey, this is Joe at XYZ Collections, I haven't forgotten you, or your account -- pay up and you'll never have to hear from me again."
Did you specifically ask that all future communications be by mail in your DV letter? If not, you might want to send them another letter. If so, keep a call log for your lawsuit.
ccbob: It doesn't matter as long as the CA hasn't complied with the validation request. Until they've validated, any communications are illegal.
It's similar to how I got out of VOICE MAIL H___ at one CRA. For some reason, I've never gotten a voice mail box since...
