i once read that for nystate the limit for derogs is 5 years... i have one derog which TU and EQ deleted but EXP is still reporting... it makes no sense b/c the date of last activity is 12/998 but they say it will be removed 2/2004 (which is neither 5 nor 7 years). according to EXP it has been "reported since" 2/1997. it was verified last year after i disputed so i am wary of disputing again... when i tell them about the 5 year NYstate thing, they always say, "no SEVEN years." so i am not sure what's going on.... maybe i can find where i read that.... any advice or info would be appreciated!! thanks!
I don't think they go by the date of last activity. They go by the date first reported. So 2004 sounds about right for the derog to fall off. Cheer up. It's only one more year. In my experience, it actually falls off in 6 years and 9 or 10 months - not the full 7 years. As for the 7 year thing: yes, unfortunately, it's 7 years across the board for all 3 CRA's.
On my "Facts You Should Know" page from equifax it states - New York State Residents Only: Satisfied judgments remain 5 years from the date filed: paid collections remain 5 years from the "date of last activity". I was able to have a judgment removed for my mother with experian after I told them this information on the phone.

unfortunately, it's 7 years across the board for all 3 CRA's. SoParkDiva ======================== Except in states that have a shorter reporting period.
Well now I'm baffled. I was able to use that little clause about 3 years ago for my friend and just this past month for my mom. However, it has only been when I speak to a person at the CRA. Go figure!
