I know there is no direct recourse for HIPAA violations, but what if the last derog on your report is caused by a HIPAA violation and you apply for something and get denied? Is there any recourse in that scenario?
I don't understand how a derog can be "caused" by a HIPAA violation. If there is a HIPAA violation it is by the OC health care provider,and it would not involve any report, as HC providers are not allowed to report to CRA's. If the OC is validatng incorrect information regarding private health data to a CA, then they can be sanctioned for THAT, but ONLY after they have been given notice that it is invalid information.
