Is this a violation?

    I know I have read it somewhere on here, but is it a violation for a CA to send me a statement again after I sent them a validation letter. They sent out this statement the same day they received my validation letter.
    A little background on this:

    It is a medical collection for $230 from 1996 with DOL of 1/1997. I have not heard or received anything from this CA in years, as a matter of fact I donâ??t recall ever receiving anything from them. (I could have but honestly do not remember). After I disputed with the two CRA â??s that is when I received a statement from them. Actually two statements about a week apart (probably one from each CRA). I disputed two times with both CRAâ??s and both times the disputes came back verified and again received these statements from the CA. After this is when I sent out the validation letter, and today I received another statement.

    I suppose this is probably good news, if they have in fact created another violation by sending this statement after I requested validation. I am not sure if this makes a difference, but at the bottom of all these statements it reads:

    In accordance with the fair debt practices act and or the fair credit reporting act, the disputed account information on the referenced account has been verified with the original creditor as valid.

    Please contact our office if there is additional information you believe has not yet been considered. In any case, please contact our office to resolve this matter.

    This communication is from a debt collector. This is an attempt to collect a debt. Any information obtained will be used for that purpose.

    Oh yeah, the last two statement now have a name at the top of them. I am thinking this case was given to her?

    If the statement was mailed out the same day they received your validation, it is entirely possible that it was already going out. It will be hard to prove they sent it due to receiving your validation.

    If I understand, you disputed this 2 times. Each time it was verified with the cra's and you then received a collection notice. You then sent a validation. I don't see any violations there.

    Thanks for the reply. I never thought about it already being on it's way out. That's probably what happened. Now, I just have to wait patiently for 3 more weeks. :)
