I disputed an account with Equifax on November 20, 2003. The letter was signed for on November 24, 2003. I previously disputed the account and the tradeline was verified. So, I submitted a new dispute on November 20 with documentation proving the trade line was a mistake. However, I never received a notice of the investigation results. So, I gave them a jingle yesterday and was told the investigation just started that day! They recieved my investigation on 11/24 and started it on 1/8? That really doesn't seem right with me. Since the dispute was actually tied into an intent to sue letter, I wonder if there was a delay due to the legal department having to handle the issue? 45 days seems a little excessive to begin an investigation!
Do you have a certified mail receipt or something that shows they received the investigation on the 24th?
Then you need to write them a letter and let them know that hey, their 30 days were up in Dec. they don't get 45 days to start an investigation. Just like in your post from the other day...get tough TU will roll.
Yes, I agree.... However, the problem is with Equifax I disputed an account with Equifax on November 20, 2003. The letter was signed for on November 24, 2003 Jlynn thought it was a problem with TU too... Simple mistake though. I have had no probs with TU in the past....just Equifax. TU is actually kind of reputable in my eyes.
OMG, you sure that your original post didn't say TU and you edited it just to drive me crazy? Its a conspiracy....Sunhawk and my children are trying to send me to the Funny Farm.
Equifax was actually closed the last two weeks in December (not that it justifies them blowing you off). Equifax is also prone to listing debts as "verified" when it get busy instead of actually doing it. did you dispute via ITS? i think that is where the problem lies. i don't know all your previous posts, but unless they were refusing to investigated, it should have been kept seperate. i would definitely make them remove those tradelines though. call and ask for a team lead.

If the completeness or accuracy of any item of information contained in a consumer's file at a consumer reporting agency is disputed by the consumer and the consumer notifies the agency directly of such dispute, the agency shall reinvestigate free of charge and record the current status of the disputed information, or delete the item from the file in accordance with paragraph (5), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer. I'm sure everyone else knew this but I just forgot...I thought there was something that stated very clearly when the investigation had to both start AND end. I found it So, there it is...right there in black and white... (or blue). They had to either delete or verify within 30 days of receiving my letter on November 24, 2003. Even if they had to hand it to the legal dept., they still have 30 days regardless from 11/24. Their reply on the phone that "The 30 days are not up yet...the investigation just started" is completely besides the point. Even if they were closed in December, they had 30 days from the date of reciept to verify or delete. Due to whatever reason, they did not start until January...their fault! Luckily, for my sake, they didn't just verify it. The actually didn't even start to investigate. This will be proved when I get my investigation results....subtract 30 days and I can easily prove that it was delayed. Although I did threaten to sue in the last paragraph of the letter, the first line clearly stated the following: I am writing you to dispute account XXXX with a name of XXXXXX. This account is not mine. Then I went on to state what documentation I had to show it wasn't mine and lastly I said if you refuse to delete I will sue. So, my dispute was not indirect like stating: I am going to sue you because I disputed an account and you verified it. Remove it or I will sue you. I did threaten suit but I also clearly disputed the account again and gave reason to why. After reading previous cases though, I do see that CRA's do sometimes say things like : Mr. Smith never asked us to re-investigate. He just said we made a mistake by verifying the account and he said he was going to sue us if we didn't delete it. You just have to be very clear that you are re-disputing for XXX reason. That's an excellent idea about the team lead. But, I just sent them out a full ITS today (with no mention of re-disputing) stating that they had 30 days to delete from 11/24 and now they MUST delete. I gave them 10 days. We will see what happens but I can see how, if I sent this letter as a dispute letter, the CRA could misconstrue it into "He never actually asked us to re-investigate." I didn't..in this letter, I just threatened to sue. I never said I am re-disputing this account (since it is being investigated as we speak). But, in the 11/20 letter I did say I was disputing the account. Do they actually allow you to talk to a team leader? I've called before demanding to talk to a manager and they always say no-one is available and they never call back when I leave a message.

I stated that, starting my dispute in January was unacceptable and I would sue them if they did not delete as required under the FCRA. I told them that they had 30 days from the date of notification to investigate and either delete or verify. Since they couldn't verify (since they didn't investigate), they had to delete. I checked to see that my letter was signed for and it was a couple days ago. However, since then, through Equifax Credit Watch Gold, when I attempt to grab my report, I receive: We're sorry, the system is temporarily unavailable. Please contact Customer Care at 1-877-47GUARD (1-877-474-8273) 24 hours a day, 7 days a week Obviously, this is some attempt by Equifax to block me from viewing my report so I can't say they did or did not delete in response to my letter. I also am unable to pull my PG report since, if one CRA refuses to release their version of your credit file, the PG 3 in 1 just shows up blank. What would you recommend?
