I recently sent Cap 1 a validation letter saying acct wasnt mine. they sent copy of original agreement which was from the beginning of 1997. Where it was one of those pre approval if you send in $150. I am a secondary account holder. signatures are listed and they sent along copies of what appear to be the last few months of statements from the end of 97 with their infamous fees beefing the defunct balance up. I presume this is adaquate validation. And since the account only has about another year to go before falling off I presume I should just let time kill it off for me, or does anyone see any further possibilities to get it dropped. The letter of validation i sent alluded tothe fact I knew nothing of the acct, etc, etc they responded with this data plus a letter that says in part: "Iassure you that we do not engage in deceptive practices. We opened this acct because we understood that the application to be authentic and that it contains truthful and accurate information. If you still have concerns about the validity of this application please contact us at the phone number below. I regret any inconvienance this matter may have caused, be assured it wasnt our intent." Any help would be welcome as I am still pretty new to the validations game. thanks
"AU" or "JOINT" makes a big difference...("AU"~~no contractual responsibility) If you had NO knowlege of the account...then yell FRAUD!!!
The approval application lists me as 'secondary' account holder. it has my DOB and SSN as well as my signature. I dont remember if my credit file says Im authorized or co owner. But I presume since I rendered the DOB and SSN and signed I am part responsible. It was not simply an authorized user space on the app where they only have space for a name.
Bump... I am guessing with it being cap 1, I am just as well to wait the year or so for it to drop my itself rather than spin wheels against them? Also, now that they have a fresh address for me (something they havent had for years) is it possible they may play with the DOLA dates to motivate me to pay? If anyone has any input let me know. thanks!
they can't reage - the date is based on what the deliquency that precluded it going into collection/chargeoff. I'm assuming it's one of those 2... Also, the OC does not have to validate as they aren't under the FDCPA (unless your state says otherwise). I'd say try disputing individual items w/in the TL itself with the CRA. For instance, Cap 1 seems to never report the true credit limit and I've heard of people getitng the entire TL dropped when the credit limit couldn't be verified.
