Is this legal?

    I was one of the "fortunate" people to be transfered from Providian (Aria) to Emerge Mastercard. In the past I had a few past due payments with Providian that showed up 1x30 days late. I now have a new line on my credit report from Emerge mastercard who is reporting that I have been late with them as well, using the information from Providian. I have only had my account transferred over to Emerge for a few months and have never been late with them. It now looks like I have two credit card accounts with negative information on them. Is this legal/right? If not or even if so, is there any way that you can suggest to have the negative information removed?

    If the Emerge card is reported as a new tradeline, it is not right, those lates need to be taken off on the Emerge. If it is still the same tradeline with a different name and account # then it is legal. Fortunately my Emerge card assumed the same tradeline as the old Getsmart card.

    Hi. It is listed as a new tradeline. The account was actually closed with Providian (Per my request due to potential interest rate hike to 29%) before it was transferred to Emerge. So it is listed as two tradelines. What would be the best way to dispute this? Should I send a validation letter straight to Emerge and explain the situation. Should I go straight to a nutcase letter and play hard or should I just dispute with CRA (Equifax)?

    Update: Emerge is now listed as never late after disputing with Equifax.
