Is this legal.

    I have a no pay on my credit file and it is making getting another mortgage difficult. If the C/A agrees to remove the derog ( and puts it is writing ) in exchange for me paying the debt, will the document be legally enforceable if they fail to remove the derog?

    BTW I live in Alberta, Canada.

    This is primaraly a US based board.

    I don't know my ass from a hole in the ground when it comes to canadian laws.

    Somone might be around later to help ya out though.

    Hi Techman,

    Provided you agreement is worded properly I don't see any reason why it wouldn't be enforcable. Afterall a contract is a contract.

    Might not wanna take our word 4 it and fire off the question to an atty first.

    Thanks Butch.

    A lawyer is firing off a letter to the O/C to try and get the issue resolved. If that fails I will get the CA to agree to dropping it in exchange for payment. They have already agreed to it but gee, I don't know why I have a hard time trusting them.
