Is this letter I sent to CC ok in your opinion?

    Good morning every one!
    - I am in my 1st month of credit disputes and sent the following letter to Citi Bank (cc'ing BBB) yesterday CMRR.

    My reasoning: Although this account is now paid in full and closed, I have so many lates I figured I needed to do something to other than dispute with the CRA, which I have not done.

    Here's my question: Did I screw up? If so, can I remedy the situation? Thanks for taking the time to read this.

    Letter to Citi:
    To Whom It May Concern:

    I recently pulled my credit report from Experian, TransUnion, and Equifax, as I am in the process of applying for a home loan. All three credit bureaus are listing the above referenced account as paying late on various occasions ranging from 30 to 150 days late.

    After cross referencing all of the late payment notations sent by Citi to the above referenced credit reporting agencies with my bank statements, certified mail receipts from payments sent, and previous credit reports pulled throughout the term of the above referenced Citi account, it is apparent that the information reported by Citi to Experian, TransUnion and Equifax is inaccurate. Also, according to the FCRA, as amended by the FACTA act, Citi was required to notify me of the insertion of negative listings, which has not been done.

    § FCRA 623 (a) (7) Negative Information

    (A) Notice to Consumer Required

    (i) In general. If any financial institution that extends credit and regularly and in the ordinary course of business furnishes information to a consumer reporting agency described in section 603(p) furnishes negative information to such an agency regarding credit extended to a customer, the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer.

    (ii) Notice effective for subsequent submissions. After providing such notice, the financial institution may submit additional negative information to a consumer reporting agency described in section 603(p) with respect to the same transaction, extension of credit, account, or customer without providing additional notice to the customer.

    (B) Time of Notice

    (i) In general. The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after, furnishing the negative information to a consumer reporting agency described in section 603(p).

    (ii) Coordination with new account disclosures. If the notice is provided to the customer prior to furnishing the negative information to a consumer reporting agency, the notice may not be included in the initial disclosures provided under section 127(a) of the Truth in Lending Act.

    Reporting inaccurate information is a violation of the FCRA. The FCRA allows for damages of $1000 per violation. There are countless violations pertaining to this account from failing to notify me to reporting inaccurately.

    Please correct this listing to â??paid as agreed â?? never lateâ? with Experian, TransUnion, and Equifax or I will seek legal action.

    if not already sent, send it to the ceo of citi, good luck they will fight to the death not to fix any mistakes

    Can I still go through the usual route?

    Can I still DV, lates not mine, Goodwill etc?
    Or will my letter be on file with Citi?
    Can I get in trouble with them for sending a sort of threatening letter?

    These may sound like wimpy questions but I am a bit panicky that I've done the wrong thing.

    File a complaint with the Comptroller of the Currency, just keep at them. I have been fighting them the last 4 months. But take my advice, if you want results, file a complaint with the OCC, you can download the complaint form online, you won't get in trouble. Just make sure you do that and stick to your story. be sure though, if you send any more letters to Citi, send them certified to the address I gave you above. You letter looks good!

    What's an OCC?

    Thanks for you reply.
    They will probably ignore the letter, so I will send it to the address you gave me.
    Should I dispute with the CRA's as well? Or not given the amount of lates I have?

    Hold off on the cra, try this first, just send the letter to the address above if you get no reply, or if you get a reply you dont want but file that complaint to the OCC! that's who supervises Citi, they are helpful.
