I sent a DV letter to Sherman Acquisiton concerning an old account with Household Bank. Today I received a letter from Alegis Group LP saying that they purchased the account from Sherman. From there the letter states: "Your recent inquiry regarding the above-referenced account has been forwarded to the Customer Service Department for research. In order to research your dispute, please provide us with the following information as it applies to your claim:" 1. A copy of your picture id 2. A copy of your social security card 3. Your signature written 3 times and notarized 4. If filed, a copy of a police report regarding the fraud 5. If filed, a notarized government Fraud or Identity Theft Affidavit 6. Proof of prior payment 7. Letters from the OC validating your claim 8. Court documents prosecuting perpetrator of fraud All I sent was a DV letter which of these things do I need to send back to them? The letter states after receiving the information they will continue their investigation.
See if you provide them with the above, they have the proof they need to validate, report to your credit report and just about anything else. I would write back and state that it is THEIR job to provide proof that you are legally responsible to pay this debt and you are not going to do their job for them. i bleieve there is a letter in the sample forum.
Which sample letter are you reffering to? I looked at the "Prove or remove it" and the "Procedure request". I'm not sure which one you're reffering to. Like you said, I don't want to send anything that can hurt me, but this letter says after they receive the info then they will investigate. I noticed that this is the same company that offered me a CC with the balance of the debt, and said I could pay it off and that would be my limit. THat was about a month ago.
they are not required by law to prove a debt HOWEVER they cannot continue collection activity until they do. i would use this opportunity to dispute with the CRA's because if they "verify" they are in violation. so here is what i would do - send a letter back to them jsut stating that you are in receipt of their letter and they should already have the information since they are attempting to collect on it. reiterate that you are not extending their timeframe to validate. once you receive the green card back from them, dispute the debt with the CRA's. i thought there was a letter but maybe not. it could have just been a letter in a thread so you may want to search the forum.
I wrote up a short letter, something like this: "I have received your letter stating you are requiring information to investigate my claim. My attorney has advised me that you should already have the information that youâ??ve requested if you are trying to collect this debt. I will once again state you have 30 days from xx/xx/xxxx, (the day of receipt of my original debt validation request), to validate that I am obligated to pay you this debt." What do you think?
Re: Re: Is this normal? <<thumbs up>> (since CN hasn't heard of smilies yet) i like it but more importantly do YOU like it and are you comfortable standing behind it?
Re: Re: Is this normal? I like it. Thanks for all your help, I really appreciate it. I notice that you reply to a lot of posts. It's good to know that there are people out there who really want to help. Thanks again, I'll let you know what happens.
Re: Re: Is this normal? I am sending the same response as I have rec. the same type letter. However, my Validation request was sent on 03-03, and this is 05-05 and they have just responded. Aren't they a little late with the counter?
Re: Re: Re: Is this normal? As long as they did not pursue any collection activity after they received your request then they did not do anything wrong
Re: Re: Re: Is this normal? Continuing collection activity includes reporting the account to a CRA, verifying to the CRA if you dispute with the CRA, and continuing to send you letters demanding payment.
