I sent a sample validation letter to a Collection Agency asking for validation of the debt they claim I owe them. I sent one of the sample letters I found on from this site asking for a copy of their contract and so forth. Yesterday, I got back in the mail a printout of what looks like my account with the cover letter asking for their money by January 31. I'm not sure what my next step should be? This is obvioulsy not proper validation like I requested. Any help would be appreciated!
The computer printout from the CA is not proper validation, as anybody can print out whatever they'd like from their computer. Your next step, IMHO, would be write to the CA, CRRR, and tell them that they did not validate correctly. I would enclose a copy of the FTC's Wollman opinion letter to support your claim that they did not validate correctly. The URL for the Wollman letter is http://www.ftc.gov/os/statutes/fdcpa/letters/wollman.htm Remind the CA of their obligation under the FDCPA to validate the debt properly. Should the CA fail again to validate properly, you'll have them on a violation of the FDCPA. HTH, John
He already has them on violations. Continued collection activity without proper validation. They sent improper validation with a collection letter. Had the validation been proper, the collection letter would have been ok. I would however send another letter with the wolman ftc letter as advised above, with a little note that if they again fail to validate, they must immediately remove the listing from the cra's.
Thanks for the suggestions. I thought that's what would be the best course of action, but just wanted to get clarification. Sorry for double posting AND for posting such a basic question. ut I can't get the search function nor the edit function to work properly. I'll keep you posted!

I can't get the search function nor the edit function to work properly. I'll keep you posted! Touchdown =============== The site needs a click fix.
I now have copies of all 3 of my reports and this Collection Agency hasn't reported to any of them. So does the advice above change? How should I handle it now since I can't force them to remove if they haven't placed anything? Thanks
Re: Re: Is this proper validation? Is this proper validation? Touchdown =============== Well, it's not a touch down as it didn't reach the goal. The END ************************* LB 59
Re: Re: Is this proper validation? They are still attempting to collect on a debt which they haven't validated. Send them the same Wollman letter telling them that if they don't validate, they should cease from any further attempts to collect the debt. If they report it since your first validation letter, they will have committed a violation!
Re: Re: Is this proper validation? 1*So does the advice above change? 2*How should I handle it now 3*since I can't force them to remove if they haven't placed anything? Touchdown =============== 1*Why should it change anything? 2*Same way. 3*Why is removal your only objective? What's to stop them from reporting it instantly at any time? What stops them from continually badgering you for payment even though or if it's not on your reports? The END ************************* LB 59
