i sent a validation letter to the ca for several accounts. a week later i got a call from them saying they were deleting 3 of my 6 accounts w/them. the remaining 3 accounts were verified and that i would receive notice from the oc. well the next day i received a letter, not from the oc, but from another company i had never heard of explaining why the 3 accounts were being deleted (never billed to ins., billing error, etc....) but the remaining 3 accounts were mine due to dr. visits for my daughters. they mentioned the dates they were seen, that the bills were for co-pays, and that they had sent out numerous notices to me. (i don't recall receiving any notices). is this validation? and who do i respond to:
the ca or the oc? i should also mention these are paid collections.

No because it did not come directly from the CA.

So do I ignore it and wait out the 30 days, then follow up with a 2nd validation letter?

I send the 15 day estoppel after 30 days.
    I don't waist time with a 2Nd. Validation.
If they don't have the proof they don't have it.
How they gonna send something they don't have in another 30 days or even 300 days for that matter??? ??

Actually, lbrown is correct. If a ca is attempting to collect, and you send them a validation request, the ca then must cease collection attempts until they ( the ca) obtains the proof from the oc and sends it to you. That is, the ca must send you the proof to be in compliance with the FDCPA. If this were me, I would send the ca a demand letter that they have not responded to your request and you therefore are demanding deletion of any derogatory listing from them. If they claim that you got validation from xyz company, my answer would then be, well if I am to deal with xyz, then you better get that listing off my report now as you have nothing to do with it.

    Good luck.

    Good Job,

The law is very specific on this issue. The CA is to obtain Val. directly from the OC and forward to you. It is expected of the CA to, in this process, double check to make sure they have the right person. That's why the law so stipulates.

ANYTHING else is outta compliance - period.

    :)

i received a call from the ca legal dept. yesterday. she admitted to me that they can not get proper validation for my accounts until i write an authorization letter for them to get my records. i asked her how she can expect me to pay for something if they don't already have proof of it? she was really nasty and said if i could only take the time that i took to write the validation letters to write an authorization letter then this would be taken care of. does she really think i'm going to validate these collections for them? i'm thinking of faxing an estoppel letter and demand that they remove any and all medical collections they reported to my cr seeing how they admitted they can't validate. what do you guys think?

i also have another question for you, at the end of june i spoke with Sally at the same ca and told her i wanted validation of an acct not on my credit report yet. she stated she needed a letter for auth. i faxed her a letter (my mistake). i never heard anything after that and when i got my cr last week, this same acct. was on my report and did not state it was in dispute or anything. now, do i have them on a violation because other then the faxed auth. letter, i didn't dispute it in writing. all of this was done on june 20 and she told me i only had until the 24th to dispute it. so i did so when i talked to her. now i have the auth letter and the fax conf. i sent to her proving i gave auth for her to get info for that acct.
I did send a validation letter Aug. 19 when i realized it was on there. but i'm just really pissed off that this lady called me with attitude because they can't validate. i have 8 accts with them and all but 1 (the one in question from June) is paid.

Any advise or help is greatly appreciated.
