Isn't illegal for a CA to "say" they are the OC ?

    I am asking b/c Fia Card Services has been calling my number looking for my daughter(who just moved out about 2 months ago).........AND when I answered the phone today and a couple other times:

    They claimed that they were BOA......................when I did some internet research, I learned that "they" were actually "FIA Card Services," a Collection Agency that was calling for a CC debt that she has with BOA.

    Another thing.......She is 19 y/o and they keep asking me if I coiuld take care of her financial debt with them..........that is a bunch of BS!

    Isn't FIA Card Services a subsidiary of BOA? I believe they process credit cards on behalf of BOA, so technically they are part BOA.

    As far as asking you to pick up your daughter's tab, they'll do whatever they can to get paid. It doesn't surprise me.

    Well, I did some further researching on my CR, and learned that they put a Hard Inquiry on my CR..........about the same time-frame as when she applied for credit with BOA.

    I mailed an Inquiry Dipsute letter to them yesterday regrding this matter because I have NOT done any businesss with them AND I'm not taking a Hard Inquiry on my CR for NOTHING!

    AND I sent them a Cease Call letter the other day (needless to say, they haven't called lately) because they have NO business calling me over and over when I have told them many times that my daughter NO longer lives here.

    Does BOA act as BOA when it interacts with its card customers before they default? And then call itself "FIA" afterwords? Dumb Bob wonders about this since games like this can sometimes cause the FDCPA to apply even to an OC.     Then consider the contract which mentions "FIA" several times:

    Dumb Bob wonders about the monthly billings and whatnot. Do they mention "FIA" at all or even just in a way anyone would likely notice or does "BOA" at the top overshadow? Would someone conclude they were dealing with BOA until suddenly after default someone from FIA starts calling and conclude that FIA is a collection agency? That appears to be what has happened in this thread.


    And if you'll pay even more, so much the better!

    I think that the problem is that are names are somewhat similar...........

    Its not your bill and even bringing it up is a violation,so you could have grounds for a lawsuit.I would throw them under the bus.
